This indenture made the 12th day
of December in the year of our Lord one thousand eight hundred and sixty
seven between Caroline Burcham of Volney Oswego County New York of the
first part and Harman Scouton of the same place of the second part
Witnesseth, that the said party of the first part, for, and in consideration
of of the sum of one dollars dollars, lawful money of the United States
of America, to her in hand paid, by the said party of the second part,
the receipt whereof is hereby confessed and acknowledged has granted, aliened,
remised, released, en[ ]pped and confirmed, and by the presents do
grant, alien, remise, release, enfeoppe and confirm unto the said party
of the second part, and to his heirs and assigns forever. All that
tract or parcel of land situated in the town of Volney on lot No Seventeen
(17) of the Seventeenth (17) Township of Scriba's patent. said parcel being
a village lot at Bradstreets Riffs and is located and described as follows:
First Tolcert Van Buren has
laid out and dedicated to the public a street adjoining the Oswego Canal,
the east line of which is eight rods or thereabout from the slope wall
of the east side of said canal & is marked by iron bolts placed in
the ground at the Southerly bank of a watercourse & runs thence south
48[degrees] East four chains and ninetylinks to an iron Bolt drove in the
earth. Secondly said village lot has its southwesterlly corner in
said street line at a stake southerly one hundred and twenty (120) feet
from an iron bolt in said street line at the southerly bank of a water
course. said lot is one hundred and eighty-nine and one half (189 1/2)
feet deep containing one fourth acre of land and being the same premises
conveyed be Catherine France to said Caroline Burcham by deed dated April
15, 1865.
Together with all and singular the
hereditaments and appurtenances thereunto belonging or in any wise appertaining,
and the reversion and reversions, remainder and remainders, rents, issues
and profits thereof, and all the estate, right, title, interest, claim
and demand whatsoever of the said party of the first part, either in law
or equity, of, in and to the above granted premises, with the said herditaments
and appurtenances, To have and to hold the above mentioned and described
premises. with the appurtenances and every part and parcel thereof, to
the said party of the second part his heirs and assighns forever
And the said party of the first part for herself and her heirs executors
and administrators, do covenant, grant, bargain, promise and agree to and
with the said party of the second part his heirs and assigns, to warrant
and forever to defend the above granted premises, and every part and parcel
therof, now being in the quiet and peaceable possession of the said party
of the second part, against the said party of the first part, her heirs,
executors, administrators and assigns, and against all and every other
person or persons claiming or to claim the said premises or any part thereof.
In witness whereof the said party of the first part her unto set her hand
& seal the day and year first above written.
