At a Surrogate's Court, held in and for the County of Onondaga, at the Surrogate's office, in the City of Syracuse, on the 5th day of July in the year of our Lord, one thousand eight hundred and sixty. Present: Samuel D. Luce, Surrogate

In the matter of proving the last will and testament of Sterling COLE, deceased Onondaga County ___. Be it remembered that heretofore upon the petition of Alanson WEST, the executor named in the last will and testament of Sterling COLE, late of the Town of Onondaga in said county, deceased, for that purpose to the surrogate of said county a citation was duly issued in this matter, which citation with the proofs of service thereof was thereafter returned to the Surrogate and which said petition and citation, with the proofs of service thereof, are now on file in the office of said Surrogate. And thereupon the last will and testament of the said Sterling COLE, deceased, with the proofs thereof were produced and are as follows, to wit: Know all these men by these presents, that I, Sterling COLE, of the town and County of Onondaga and State of New York, Farmer, considering the uncertainty of this life and being of sound mind and memory, do make, declare and publish this my last will and testament. After the payment of all my debts, including the sum of seven hundred and fifty dollars, which I owe my son Amos for money received of him and the payment of funeral expenses. First, I give and bequeath to my wife Permelia the sum of Two hundred Dollars and all the clothing she has made or purchased since our marriage, and this to be in lieu of Dower. Second, I give and bequeath to my daughter Charlotte the sum of Two hundred Dollars. Third, the remainder to be equally divded between my sons, Horace, Alvin, Elisha, and Amos COLE, Except Alvin to have one hundred dollars less than Horace, Elisha and Amos, Alvin having had of me one hundred dollars more than the others. Fourth, I do nominate and appoint Alanson WEST of the town of Onondaga to be the Executor of this my last will and testament and hereby authorize him to sell all my real estate and personal property at Auction or private Sale and apply the same to the payment of all my debts and then the several legacies above mentioned. In testimony where I have hereunto set my hand and seal and published and decree this to be my last will and testament in presence of the witnesses named below this 18th day of December 1858.
