At a Surrogate’s Court held
in and for the County of Onondaga, at the Surrogate’s Office, in the City of
Syracuse, on the 16th day of June, A. D. 1890.

In the Matter of Proving the Last Will and Testament
of
Isaac Olmsted, deceased.
Onondaga
County, ss. Be it Remembered,
therefore upon the petition
of Jeremiah Olmsted, the executor named in the last will and testament of Isaac Olmsted, late of the town of
Spafford in the County of Onondaga, New York, deceased, for that purpose to the
Surrogate’s Court of said county a citation was duly issued in this matter
which citation was proof of the due legal service whereby on all the proper
parties was therefore returned to said Surrogate’s Court which said petition
and citation with the proofs of service thereof are now on file in the office
of the Surrogate of said county; and therefore the last will and testament of
said Isaac Olmsted, deceased, and the proofs thereof were produced and are as
follows to wit;
To whom it may concern know ye: that I, Isaac Olmstead of
the town of Spafford, in the County of Onondaga, and State of New York and
being of sound mind and memory and considering the uncertainty of this frail
and transitory life do therefore make publish and declare this to be my last
will and testament that is to say:
First, After all my lawful debts
and funeral expenses are paid and
discharged, I give and bequeath to my wife, Eunice Olmstead five hundred
Dollars in her own right to have and to
hold the same, her heirs and assigns forever. I also give to my said wife the
use of my house & Lot and about ten acres of ten acres of land that I now
own and occupy situate in the town of Spafford in the Village of Borodino NY
during her natural life and at her decease I give and bequeath my said house
and lot and land above mentioned to my son Jeremiah Olmstead by his paying my
daughter Mary Ide four hundred Dollars to have and to hold the same forever
their heirs and assigns. Second,
I give and bequeath to Eva Olmstead, David Olmstead, Isaac Olmstead Jr., Lee
Olmstead, Jay Olmstead, Adda Streeter, Beryl Olmstead and Grant Ide Two hundred
Dollars each to be paid to each of them by my executor at the time they
severally become of the age of twenty one years.
Third, I give and bequeath to my
son Jeremiah Olmstead and my daughter Mary Ide all the rest and remainder of my
estate both real and personal to be equally divided between them share and
share alike to have and to hold the same, their heirs and assigns forever.
Therefore, I make,
constitute and appoint my son Jeremiah Olmstead to be the executor of this my
last Will and testament hereby revoking all former Wills by me made.
In Witness Whereof, I have
hereunto subscribed my name and affixed my seal the fifth day of March in the
year of our Lord one thousand eight hundred and eighty seven.

The above written instrument
was subscribed by the said Isaac Olmstead in our presence and acknowledged by
him to each of us and he at the same time declared the above instrument so
subscribed to be his last will and testament and we at his request have signed
as witnessed hereto in his presence and in the presence of each other and
written opposite our names our respective places of residences.
