Will of Lucinda Garrison
BE
IT REMEMBERED, that on the 10th day of March in the year of our Lord
one thousand nine hundred (nine) and six the Last Will and Testament of Lucinda
Garrison late of the town of Catskill in the County of Greene and State of New
York, deceased, was duly proven before Hon. Josiah C. Tallmadge, Surrogate of
the said County of Greene, according to law, as and for the Last Will and
Testament of the real and personal property of said deceased; which said Last
Will and Testament and the proofs and examinations taken in respect to the same
are as follows, to wit:
In
the name of God Amen: I Lucinda
Garrison of the town of Cairo, Greene County, New York being of sound and
disposing mind and memory, do make publish and declare this to be my last will
and testament, in manner and form following that is to say:
First. I direct that all my debts and funeral expenses (not including the mortgage debts of Charles Garrison hereinafter mentioned) be paid out of the rest and residue of my property hereinafter mentioned.
Second.
I give and devise to my son Charles
Garrison all that part of the homestead farm owned by my late husband at his
decease and now owned by me, that lies east of the creek and which part so
devised includes the buildings on said homestead farm. This devise to said
Charles Garrison is made subject to a mortgage to this day given by me to him,
on said premises, and he is to take said premises subject to said mortgage, and
shall have no claim against my estate on account of said mortgage or of the bond
accompanying the same.
Third.
I give and bequeath to each of my
children, James, Angeline and Eliza the sum of five dollars.
Fourth.
All the rest residue and remainder of my property and estate, real
personal and mixed which I shall own at my decease, wheresoever at whatsoever
the same may be I give devise and bequeath to my four children, George Garrison,
William E. Garrison, Rachel A. Covell and Mary Apply in equal shares and to
their executors administrators and assigns forever, subject however to the
execution of the power to sell or mortgage hereinafter mentioned.
Fifth.
I do hereby authorize and empower
the executor of this my last will and testament to sell or mortgage any of the
real estate which I shall own at my decease not herein devised to my son
Charles, in order to pay my debts and funeral expenses and the expenses of
administering my estate.
Lastly,
I do hereby nominate and appoint my son-in-law Charles E. Covell to be the
executor of this my last will and testament hereby revoking all former wills by
me made.

whereof I have hereunto set my hand and seal this 24th day of
February 1887.

Garrison and Rachel A. Covell of Catskill, New York; George Garrison of
Palenville, New York; James Garrison, Angeline Evans and Eliza Evans of Albany,
New York; William E Garrison of West Albany, New York; Charles E Scofield,
William E. Appley, James A. Appley and Alice M. Fry of Schenectady, New York;
Margaret Peck of town of Niskayuna, Schenectady County, New York; and Charles E
Smith of the town of Rotterdam, Schenectady County, New York.
The heirs at law
and next of kin of Lucinda Garrison, late of the Town of Catskill in the County
of Greene, deceased, Greeting:
WHEREAS, Charles
E. Covell of the Town of Catskill and County of Greene, has lately applied to
our Surrogate’s Court of the County of Greene, to have a certain instrument in
writing, relating to real and personal estate, duly proved as the last Will and
Testament of the said deceased;
You and each of
you are hereby cited to appear before the said Surrogate, at a Surrogate’s
Court to be held at his office in the Town of Catskill, in said County of
Greene, on the 8th day of March 1906, at ten o’clock in the
forenoon of that day, then and there to attend the probate of said last Will and
Testament.
And if any of the
persons interested be under the age of twenty-one years, they are required to
appear by their guardian, if they have one, or if they have none, to appear and
apply for one to be appointed, or in the event of their neglect or failure to do
so, a guardian will be appointed by the Surrogate to represent and act for them
in the proceedings.

We, Charles
Garrison and Rachel A. Covell, of Catskill, New York; George Garrison, of
Palenville, New York; James H Garrison, Angeline Evans and Eliza Evans of
Albany, New York; William E. Garrison, of West Albany, New York; and Charles E.
Scofield, William E. Appley, James A. Appley and Alice M. Fry, of Schenectady,
New York, the undersigned, being eleven of the heirs at law and next of kin of
Lucinda Garrison, late of Catskill, New York, deceased, and of full age, do
hereby severally stipulate, that the instrument purporting to be the last will
and testament of the said Lucinda Garrison, bearing date February 24, 1887, and
signed at the end thereof by the said Lucinda Garrison by her mark, and by
Joseph Hallock and Henry D. Shores (both since deceased), as subscribing
witnesses, a copy of which instrument is hereunto annexed, marked “A” and
made a part hereof, is the last will and testament of the said Lucinda Garrison,
and was at the date thereof duly signed, sealed, published and declared by said
Lucinda Garrison as and for her last Will land testament, in the presence of
said Joseph Hallock and Henry D. Shores, who at her request, and in her
presence, and in the presence of each other, subscribed their names as witnesses
thereto; that at the time of such execution the said Lucinda Garrison was of
sound and disposing mind and memory, over the age of twenty-one years, and not
under restraint; that said instrument relates to personal property; and that the
said Lucinda Garrison was at the time of her death a resident of the town of
Catskill, Greene County, New York.
And we do hereby
severally appear in person and waive the issue and service of a citation in the
above entitled matter, and severally consent that said instrument be forthwith
admitted to probate as a valid will of personal property without notice to us.

PETITION FOR
LETTERS OF ADMINISTRATION
To The
Surrogate’s Court of the County of Greene:
The Petition of
Lucinda Garrison of the town of Cairo, in the county of Greene, respectfully
showeth:
that Jacob
Garrison died at his residence in the town of Cairo, in the county of Greene, on
or about the 26th day of September, 1884, being at the time an
inhabitant and resident of the said county of Greene; that said deceased left no
Will, as far as your petitioner has heard or been able to discover; that he left
surviving, Lucinda Garrison, his widow, and your petitioner herein residing in
the town of Cairo, Greene County, N.Y. George Garrison, a son & Rachel A.
Covell, a daughter, both residing in the town of Catskill, Greene County, N.Y.;
James Garrison, a son, Angeline Evans, a daughter and Eliza Evans, a daughter,
all residing in the city & county of Albany, N.Y.; Mary Appley, a daughter,
residing in the city & county of Schenectady, N.Y.; and Charles Garrison, a
son, residing in the town of Cairo, Greene County, N.Y. his only heirs at law
and next of kin being all of full age.
And your
petitioner further showeth that the personal estate of said deceased does not
exceed in value the sum of $2500; that your petitioner is the widow of the said
deceased.
Your petitioner
therefore prays that Letters of Administration of the goods, chattels and
credits of said deceased may be granted to Lucinda Garrison, your petitioner,
jointly with George Garrison, and your petitioner consents to such appointment.
