This indenture made the this sixteenth day
of June one thousand eight hundred sixty between HENRY W. BRIGGS and MARY J.,
his wife, of Athens in the county of Greene and state of New York of the first
part and GEORGE THOMPSON of Catskill in the county and state aforesaid of the
second part. Witnesseth that the said parties of the first part, for and in
consideration of the sum of three hundred (300) dollars to them in hand paid by
the said party of the second part do grant bargain sell and confirm unto the
said party of the second part and his heirs and assigns forever. All the certain
pieces parcels or lots of land situate, lying and being in the upper village of
Athens in the county and state aforesaid, bounded and described as follows: VIZ:
Lot number nineteen hereby intended to be conveyed is bounded on the north by
lot number twenty one, on the west by lot number twenty, on the south by lot
number seventeen and on the east by Hudson Street. And lot number seventeen
hereby intended to be conveyed is bounded on the north by lot number nineteen ,
on the west by lot number eighteen, on the south by lot number fifteen, and on
the east by Hudson Street. And it is also agreed by and between the parties to
these presents that the parties of the first shall and will keep the buildings
erected and the erected upon the lands above conveyed, insured against loss by
fire and assigns the policy and certificate thereof to the said party of the
second part, his executors, administrators or assigns: and in default thereof,
it shall be lawful for the said party of the second part, his executors,
administrators and assigns to effect such insurance, and the premium and
premiums paid for effecting the same shall be in lien on the mortgaged premises,
added to the amount of the said bond or obligation and secured by these
presents. This conveyance is intended as a mortgage to secure the payment of the
sum of three hundred dollars in manner following, TO WIT: one hundred and fifty
dollars in one year from the date of these presents: and one hundred and fifty
dollars in two years from the day of the date of these presents; with the
interest on the amount due payable at the time of each payment according to the
conditions of a certain bond dated this day, executed by the said HENRY W.
BRIGGS, to the said party of the second part; and there presents shall be void
if ever payment be made. But in case default shall be made in the payment of the
principal or interest as above provided, then the party of the second part , his
executors, administrators or assigns are hereby empowered to sell the premises
above described, or any part thereof, in the manner prescribed by law: and out
of the money arising from such sale, to retain the said principal and interest,
together with the costs and charges of making such sale ; and the surplus if any
there shall be paid by the party making such sale, on demand, to the said party
of the first part or to his heirs or assigns. In witness whereof, the said
parties of the first part, have hereunto set their hands and seals the day and
year first above written.
