Henry Hull to Robert Seamans-1815 Deed

This Indenture made the thirteenth day of April in the year of our Lord One thousand Eight hundred and fifteen Between Henry Hull and Easther his wife of the town of Fishkill in the County of Dutchess and State of New York of the first part and Robert Seamons of the same place of the second part Witnesseth that the said parties of the first part for and in consideration of the sum of Four Hundred and Eighty dollars to them in hand paid at or before the ensealing and delivery of these presents by the said party of the second part the receipt whereof is hereby confirmed & acknowledged hath granted bargained sold aliened remised released conveyed, assured enfeoffed and confirmed. And by these presents, doth grant, bargain, sell, alien, remise, release convey assure enfeoff and confirm fully freely and absolutely unto the said party of the second part in his actual possession now being and to his heirs and assigns forever. All that certain lot piece or parcel of land situate lying and being in the town County and State aforesaid being a part of the lot of Land that the aforesaid Henry Hull bought of Caleb Peck formerly owned by Gideon Baxter. Butted and bounded as follows viz. Beginning at a Black oak tree marked [?] an d[?]g the West side of the Brook in Caleb Pecks line from thence running North sixty degrees West seventy seven links to a stake and Stones, then South thirteen degrees West five chains and seventy Links to the middle of the Road in the aforesaid Robert Seamans line then in Company with said Seamans line and the middle of said road South seventy three degrees East two chains thirty nine links then South sixty degrees & fifteen minutes East three chains and twenty three Links, then north fifty seven degrees and forty five minutes East two chains and sixty two Links to a stake and stones the East side of the brook about five rods then north eighteen degrees and fifteen minutes West seven chains and Eighty three links to a stake and stones near a Walnut Sapling marked in the corner of the aforesaid Caleb Pecks land then along said Pecks line South sixty five degrees West three chains and fourteen links to the place of Beginning. Containing three acres three rood and twenty Eight perches of Land. Together with all and singular the appurtenances privileges and advantages whatsoever unto the above mentioned and described premises in any wise appurtaining or belonging and the reversion and reversions remainder and remainders rents issues and profits thereof. And also all the estate right title interest property claim and demand whatsoever as well in law as in equity of the said parties of the first part of in and to the same or any part or parcel thereof with the appurtenances. To have and to hold the above granted bargained and described premises with the ap-purtenances unto the said party of the second part his heirs and assigns to him and their own proper use benefit and behoof for ever. And the said Henry Hull and Easther his wife for themselves & their heirs doth covenant promise grant and agree to and with the said party of the second part his heirs and assigns that the said Henry Hull and Easter his wife at the time of the sealing and delivery of these presents is Lawfully seized in their own right of in and to the aforesaid described premises hereby granted and conveyed with the appurtenances as of a good free perfect absolute and indefeasible estate of inheritance in the law in fee simple without any manner of condition to alter change determine or defeat the same. And hath in themselves good right full power and lawful authority to grant bargain sell convey and release the above said described land and premises with the appurtenances unto the unto [sic] the said party of the second part his heirs and assigns in manner aforesaid. And also that he the said party of the second part his heirs and assigns shall and may from time to time and to at all times & forever here-after peaceably and quietly have hold occupy possess and enjoy the said hereby granted and bargained premises with the appurtenances And also that the said parties of the first part and their heirs and all and every other person or persons whomsoever lawfully or equitably deriving[?] and estate right title dower jointure or interest of in or to the herein before granted premises by from under or in trust from him and there shall and will at any time or times hereafter upon the reasonable request of the said party of the second part his heirs and assigns and at the proper costs and charges of the law of the said parties of the first part their heirs or assigns make do and execute or cause or proceed to be made done and executed all and every such further and other lawful and reasonable conveyances and assurances in the law for the better and more effectually vesting and confirming the premises hereby intended to be granted in and to the said party of the second part his heirs and assigns for ever as by the said party of the second part his heirs and assigns or his counsel learned in the law shall be reasonably devised advised or required. And the said parties of the first part for themselves and their heirs covenant and agree to and with the said party of the second part his heirs and assigns to Warrant and by these presents forever to Defend the above described and released premises and every part and parcel thereof to the said party of the second part his heirs and assigns against the said parties of the first part and their heirs and against all other persons whatsoever lawfully claiming the same or any part thereof. I Wheeler Gilbert One of the Masters in Chancery for the State of New York do certify that on the fifth day of July One thousand Eight hundred and fifteen personally appeared before me Henry Hull and Easther his wife known to me to be the persons described in and who executed the within Indenture. And they acknowl-edged they executed the same. And the said Easter being by me privately examined separate and apart from her said Husband acknowledged she executed the same freely without any fear or compulsion of her said husband.
