[13851] Salt Lake City Herald, Salt Lake City In Self Defense Billy Nuckolls Kills a Man at Leadville In the following special telegram to the Denver News, which is self explaned story, the Billy Nuckolls referred to is doubtless, a son of the late S F Nuckolls of this city. Billy did not live here with his family, but made several visits to this city, during his fathers residence here, and from his quiet, gentlemanly and peaceable manners, it is easy to believe that the deed mentioned below was, as is calimed, committed either in defense of his own life, or accidentally. Here is the dispatch: Leadville Colo Spet 11-Great interest has been taken here in the Sager killing, which occurred in Garfield county on Friday. Mr Emmett Nuckolls, this city, an uncle of the murderer, Billy Nuckolls, was interviewed regarding this matter, and stated that according to the story told him by Billy the murder was done in self defense. Sager, Nuckolls siad, had an axe. Sager was in a wagon with a boy the day of the murder and was riding through Nuckolls' hweat field, destroying the grain. Nuckolls commanded him to stop, and Sager said to the boy, "Give me that axe. I am going to kill the d----d son of a gun". Whe he said that, Nuckolls fired and Sager fell over wounded. Nuckolls said the gun was double action and he fired in the excitement of the moment. His only idea, he said, was to scare Sager. This is the story as told by Nuckolls and is given for what it is worth, although in direct conflict with the telegraphic reports.
[13852] Rocky Mountain News, Denver Sun, Dec 9, 1888 Col A Glenwood Springs Co Dec 3- Early this morning the jury in the case of the People vs William Nuckolls for the murder of John Sager returned a verdict of "not guilty" and the prisoner turned loose. Nuckolls departed for Leadville roday. The killing occured the 7th of inst September, on a disputed ranch on Garfield Creek. Opinion is considerably divided on the result of the trial.
[13853] Rocky Mountain News, Denver, Tuesday Dec 11 1888 Threatened in Lynching Aspen Colo Dec 10- Sensational reports reached here concerning the Nuckolls-Sager case at Glenwood. It is said that a party of Sager's friends are organizing to lynch Nuckolls who was found not guilty at his trial for the murder of the former, a few days ago. Mrs Sager has brought a damage suit against Nuckolls and obtained a verdict of $5000 damages for the killing of her husband. The defendants are trying to get the case reopened, as the judgement was taken by default and the case will come up before George D Johnstone as referee tomorrow or next day. It is also said th at a suit is about to be brought against Nuckolls for the care and maintenance of some minor children, the sum sued for amounting to several thousand dollars.

Said northwest quarter of the northwest quarter of Section 31 being also known as Lot 2; said deed herein duly recorded in Book "D" page 269, 270 in the recorder's office in Fremont County, Iowa and on the 11�sup�th�/sup� day of March, 1861 the District Court set said deed aside, all parties interested consenting thereto but the dec- did not describe the land and referred to the description as set forth in the petition in said suit, which has since become lost and cannot be found, and on account of said lost petition, the record title is clouded. That said Thomas Ripley is a non resident of Iowa and it is not known whether he survives and if he is deceased, his heirs are unknown, and it is not known whether of not he left a surviving spouse and if he did , and she has departed this life, it is not known who her heirs are, although diligent search and inquiry has been made, but without avail. Plaintiffs claim that Heath Nuckolls at one time owned the south one-half of the Southwest quarter section of Section 30, and Lot 2 in Section 31, Twp 67, Range 42, and later conveyed said to Stephen F Nuckolls,, said Heath Nuckolls had his deed recorded in Book "I" Page 524,525 deed records of Fremont County Iowa and when he conveyed said Lot 2 to Stephen F Nuckolls, deed was recorded in Book "S" page 292,293 in Fremont County Iowa, in the recorder's office and it does not appear that Heath Nuckolls conveyed the south one-half of the southwest quarter to Stephen F Nuckolls, but it is believed that he did, and the deed was never placed on record. Plaintiffs state that Asbury Jacks, one of the plaintiff's grantors had conveyed to him by Stephen F Nuckolls and wife on June 3, 1895, the southeast quarter of the southwest quarter of Section 30, Twp 67 Range 42, and that Heath Nuckolls was aware of said conveyance by his brother, Stephen F Nuckolls, to Asbury Jacks and acquiseed and ---- same and that said Heath Nuckolls departed this life in 1907, left surviving him his widow, Susan F Nuckolls, a daughter Lulu, now the wife of J E Wesner, and the following grandchildren: Constance R Carey, William H Carey, Abbie Carey, Alice Carey and Anna M Carey. Their mother, Anna Nuckolls who intermarried with William B Carey having died prior to the death of her father. [7455] Fort-Worth Star Telegram Keller Man Gives Reunion Banquet on 90th Birthday W G Nuckolls of Kellar celebrated his ninetieth birthday Feb 1 with a dinner to his relatives and freinds at Kellar. Nuckolls, who in spite of his age, is very active, can walk several miles, and splits all of the wood his family uses, is one of the oldest citizens, of Kellar. He settled near Keller fifty years ago coming from Tennessee, and has been in and around Kellar since. Nuckolls cast his first vote in a presidential election in 1852, voting for Franklin Pierce the fourteenth President of the United States, who was a Democrat and Nuckolls has always voted the Democratic ticket, except shortly after the civil war, when he voted for Horace Greely. Nuckolls served in the Confederate Armies, and voted for Greely, he says because he was instrumental in feeing Jefferson Davis from prison. Nuckolls voteds for Wilson for re-election in the Star-Telegram's Straw voting contest. Nuckolls is a lifelong Baptist, and has been a Mason for Sixty-Three years. He claims to be one of the oldest Masons in the state. His second wife, Mrs Ruth Nuckolls is living and he has five chldren, three stepchildren, and a number of Grandchildren living. Those who attended his birthday party Sunday were: Mr and Mrs S H Bobb, Miss Ellis Bob b, Mr and Mrs J C McCoy, Misses Betsie Halt and Rose Winifred McCoy, Mrs M F Gates, Miss Dorothy Turbeville, Mr and Mrs Ed Crittenden and Margaret Crittenden all of Fort Worth; H E Happ of Tennessee' Mrs J W McCoy of Pilotler, Kenneth Miller, Helen Ruth Miller, all of Kellar and the pastor of the Point; Lewis Bourland, Mrs E K Miller, Keller Baptist Church

T here is Dialpha, age 6 son, which would be the age of William Hiram. But we now find, there is a Dialpha Frances, who was an unknown daught er of Thomas Peter and Mary Nuckolls, and yet she was thought to have been born in 1870. It's a confusing census, and more confusing to find sibs of William Hiram of whom we were unaware.)
