Rutherford County was formed in 1779 from Tryon County. The county was named for Griffith Rutherford, a Revolutionary War General and Provisional Congressman. It is surrounded by Polk County, North Carolina; Henderson County, North Carolina; Buncombe County, North Carolina; McDowell County, North Carolina; Burke County, North Carolina; Cleveland County, North Carolina; Cherokee County, South Carolina; and Spartanburg County, South Carolina.
The act establishing Rutherford County ordered that the first court be held in the home of Joseph Walker. Commissioners were to be chosen and land purchased for a County Courthouse. In 1781, an act was passed stating that the original act was not fully completed. The site chosen was at the fork of Shepard's Creek on land owned by James Holland. The new act authorized the purchase of fifty acres from James Holland and to erect the buildings. In 1784, a new act was passed stating that the original land purchased from Mr Holland was not convenient and new commissioners were chosen to select a new plot for the county seat. In 1787 Rutherfordton was established. Rutherfordton was incorporated in 1793 and named as the county seat.
In 1791, parts of Rutherford and Burke Counties were used to form Bumcombe County. In 1841, parts of Rutherford and Lincoln Counties were used to form Cleveland County. In 1842 parts of Burke and Rutherford were used to form McDowell County. In 1855, parts of Rutherford and Henderson Counties were used to form Polk County.
The County Courthouse burned in 1907. Officially, no records were lost at that time.
