"Dicken: "Moses and Aaron were named among the Revolutionary soldiers of Chatham Co. NC in Capt. Turner's Company under the command of Col. McDowell, 15 Mar to 30 Jul 1779 ("Roster of NC Soldiers of the Revolution", p. 597). before 1790 they moved from NC to Franklin Co. GA; but, when the Tugaloo River became the boundary line, they were officially in Pendleton Co. SC, as shown in the 1790 census. In 1793 Moses was back in Franklin Co. GA and was Justice of the Peace. GA records show that he was still in that state in 1809, but in 1816 he was listed as a taxpaper in Amite Co. MS (Don Terrill): Moses' will was written 4 Jan 1828 and proved 21 Feb 1831 (Amite Co., Miss., Will Book "1" p. 66). In it he names his wife Nancy, sons John and Hiram, and daughter Rebecca." "Benjamin Waller was a respected and influential lawyer, civil servant, community leader, and land developer. Born in King William County, Virginia, Waller was a student at the College of William and Mary and later studied law using Sir John Randolph's law library. He later imparted some of his legal training to George Wythe.


Due in part to the influence of his patron, Secretary John Carter, Waller received appointments to a number of important and lucrative positions. He served as clerk and burgess for James City County, recorder of Williamsburg, vestryman of Bruto Parish Church, and judge of the Court of Admiralty, to name a few of his many offices.


Waller also was a land developer. He purchased several parcels of land on the east side of Williamsburg and subdivided a portion of the property into smaller lots, many of which were bought by craftsmen who paid 10 pounds for each lot. Purchasers had to agree to build a 16- by 20-foot house with a brick chimney within three years.


Waller married and had 10 children, 6 daughters and 4 sons. His wife, Martha (Hall), tended to the household, overseeing the children and directing the work of their several slaves. One of his grandsons, William Waller, married the daughter of U. S. President John Tyler and lived in Benjamin Waller's house in Williamsburg."

"He was the youngest child of a numerous progeny, and was born in the County of King William on the Mattapony river, opposite what is now called Walker-town,(4) where his father Edmund Waller then dwelt.(5)


(5) Benjamin Waller's father was not Edmund, but John--Colonel John Waller (1673-1754) who emigrated to Virginia during the last years of the seventeenth century.


Settling in King and Queen County on Enfield plantation (which became part of King William when the latter was formed in 1701), he served as justice of the peace, sheriff, and burgess (1710-1714, 1720-1722) for King William. About 1696 he married Dorothy King; they had six children, of whom Benjamin, born October 1, 1716, was the fifth.


Colonel Waller moved his family to Spotsylvania County about 1723-1726, where he named his new plantation "Newport" for his birthplace--Newport Pagnell, Buckinghamshire. In 1722 he became the first clerk of Spotsylvania, a position which remained in the family through five successive Wallers until 1786 (Andrew Lewis Riffe, "The Wallers of Endfield, King William County, Virginia," Virginia Magazine of History and Biography, LIX [1951], 343,344, 347-349, 461).


(6) Col. John Waller was not directly descended from Edmund Waller, the English Restoration poet. They did, however, have a mutual ancestor, Robert Waller of Beaconsfield, Buckinghamshire, who died in 1545 (John G. Herndon, "Waller Genealogy," William and Mary Quarterly 2nd ser., XX [1942], 3122-316).1 For illustration of the Waller coat of arms bearing the motto HAES FRUCTUS VIRTUTIS ("This is the fruit of virtue"), see Riffe, "Wallers of Endfield [sic]," VMHB, LIX, tip-in between pp. 492-493.
