James m. a widow Jean (Jane) Lindsay Winter who was sister to Mary Lindsay, wife of his older brother Zachariah. James and Jean De Hay had no children and at his death the property was left to Jean for her lifetime and then bequeathed to the three Winter children.


CONFLICT: 4 children - add Hugh S. Winter submitted by


James Dehays Will is in C. P. O. Book 38, page 668. He bequeaths all to his wife Jean. After her death, the estate is to be sold and proceeds divided between Robert P. L. Winter and Ellizabeth Jean Winter; debts paid and of the residue: one hundred dollars to niece, Elizabeth Dehay; three hundred dollars to nephew Benjamin Dehay; Exec: Robert. F. L. Winter, Benj. Dehay, Jr., and John Packer. Dated 13 July 1826. Proved 31 Dec 1829.


Charles John Steedman, Sheriff of Charleston District, to James Dehay, Conveyance. This Indenture made ? day of ? in the year of our Lord, 1800, and in the thirtieth year of American Independence---of the one part, and James Dehay of the same District aforesaid---Whereas Hugh Steven Winter in his lifetime and at the time of his death was seized in his demesne of Estate of Inheritance of a tract of land ---hereinafter described, and whereas also James Dehay and Jane Dehay and James Winter prayed that a writ of partition be made. (a commission was named to investigate the matter.) They reported to the court that the said land would not bear a division without manifest damage to the heirs, and they recommended that the land be sold.


The land bordering on lands of Mr. Porcher, Mr. Thornley and to the west on lands of Hugh Winter and Capt. James Dehay was sold by the Sheriff to James Dehay for $55.00. Recorded 13 May 1813.


In Register of Mesne conveyance W 13" page 384. An Indenture of Catherine and P. M. Wolton to Mary M. Magucy, wife of Z. T. Deahy, Josephine E. Dehay, Estelle E. McQueen and John A. Wolton. Release of life estate in lot of land for love and affection I have and bear for my said children ---tract of land on Charleston Neck. Recorded 21 oct 1857. In R. M. O. Book M 13' pate 38:
