By the time of the Civil War, Joshua and Sallie had seven
children with another on the way. Late in the war, even publicly
active men in their forties with large families such as Joshua
were called to serve. According to the Confederate Pension
Application filed by Sallie, at age 71, in November of 1899,
Joshua served in Company H Morgan's Battalion and Parsons
Brigade from March of 1864 until the surrender in April of 1865.
After the war, Confederates who served at the rank of Major or
above or who had been elected officials were not automatically
granted pardon's. They were required to apply for and receive
individual pardon's in order to regain their full rights or to
run for elected office. Joshua applied for and attained a
pardon, but his last office was his undoing. After the civil
war, the residents of Panola, as in many areas of the south,
suffered great hardship under reconstruction. Joshua served as
grand Jury bailiff and Deputy County Tax Collector, While his
two eldest sons, John Holland Cherry (named after his maternal
grandfather, Revolutionay War Hero, John Holland) And Charles R
Cherry served as Deputy Sheriff's. Joshua was murdered October 1
1868, while attempting to collect very unpopular war taxes.
Though the evidence is not conclusive, official records and
family accounts indicate Joshua was stabbed in the heart by an
irate store owner who, as a member of a prominent local family,
went unpunished.
In May of 1871, deputies John H and Charles R Cherry were
involved in a shootout which claimed the life of Charles.
According to family history, Joshua's brother Ezekial K Cherry,
Joshua's two oldest son's, John and Charles, and other family
members had a shootout with the killer in revenge for Joshua's
murder. Deputy John H Cherry was arrested, but later charges
were dropped and he married Samantha Carter in Carthage October
15, 1872. It appears John and Samantha did not stay in Texas as
no other records of them were found.
The Panola Watchman was not published in 1868, at the time of
Joshua's death, or in 1871 when his murder was avenged.
Joshua's personal appearance approx 5'8" dark hair blue eyes
heavyset, light complexion (from his Mex. War Pension
application).
