Joseph executed a deed in GA on 4 Jan 1805, in which he deeded his estate both real and personal, to his children. The deed stipulated that all his property be equally divided among his children when the youngest son reached the age of eighteen and though it was a deed, it was worded much like a last will and testament.


There was also executed an Inventory in the West Feliciana Parish, LA probate records, St. Francisville, of the estate of Joseph Higginbotham. Neither the deed in GA or the LA probate papers mention his wife Frances, although another set of probate papers in East Feliciana Parish seems to suggest that she lived in Virginia where she died. We also find a deed for the sale of land on "sandy Creek", dated Feb 1820, containing the names of Frances Higginbotham along with Willis and Lindsey Higginbotham. We know that Willis and Lindsey were Frances' sons, but the "Frances" might have been their uncle "Francis" Higginbotham, who also lived in the area.


There are probate records on two "Joseph Higginbothams and two Frances/Francis Higginbothams"; the two Josephs were an uncle and nephew -- the latter cousins, a female and male. The evidence is inconclusive about where and when Frances died, but a petition dated 1824, clearly ties this family to Moses and Frances Kyle of Amherst Co. VA, and clearly states that Frances died in Virginia, leaving property to her children in Lousiana. However, a careful study of the available information strongly suggests that it was their "Grandmother Frances" who died in 1825 in Virginia leaving property which they inherited through their mother Frances.
The confusing arises because both their mother and grandmother were named "Frances Higginbotham" and both could have died about the same time. [S186] [S453]

BIOGRAPHY: The family of LOWE was established in England by one of the companions of William the Conqueror, and has presented a male successor since that remote period. Low is an old English word for a small hill, and the seat of the family being on a gentle elevation on the north side of the river Ferne, they apparently took their name from their location. From a branch that were located in Co. Derbyshire, England was descended Patrick Lowe, of Derby. who married Jane and had issue: among others a son, John Lowe, who emigrated to Maryland about middle of the 17th Century. (the dates for Patrick and John are too far apart... I suspect we are missing a generation!}

Polk, Marshall Tate (1831-1884) -- also known as M. T. Polk -- of Bolivar, Hardeman County, Tenn. Third cousin twice removed of Charles Polk; nephew and adoptive son of James Knox Polk; fourth cousin once removed of Trusten Polk; nephew of William Hawkins Polk; third cousin by marriage of George Davis; third cousin once removed of Frank L. Polk. Born in Charlotte, Mecklenburg County, N.C., 1831. Democrat. Colonel in the Confederate Army during the Civil War; delegate to Democratic National Convention from Tennessee, 1876; Tennessee state treasurer, 1877-83. Wounded at the Battle of Shiloh, during the Civil War, and lost a leg. In 1883, a $400,000 shortfall was discovered in the state treasury. Polk fled to Texas, was arrested there, and brought back to Nashville. Charged with embezzlement, he pleaded not guilty -- his lawyer argued he was only guilty of "default of pay" -- but was convicted, sentenced to twenty years in prison, and fined. Imprisonment was delayed pending his appeal. Died in Bolivar, Hardeman County, Tenn., February 20, 1884. Interment at Polk Cemetery, Bolivar, Tenn.
