"John Fearn was a captain during the Revolutionary War. His will was proved in Buckingham County 8 Apr 1782 and 11 Nov 1782, and registered in Campbell County, Kentucky on 27 Aug 1827. It named his children Thomas, John, Samuel (the last two not yet 21), Fanny Putney, Jane, Ann, and Mary (Jane, Ann, and Mary underage). Campbell Co., KY: Will Book B;224, 225, 226, and 227. (Copy sent to Historic Buckingham)


Will: I JOHN FEARN of Buckingham County do make my last will and Testament as follows. I having heretofore made ample provisions for my son THOMAS, I shall give him nothing by this my will. I give and devise to my sons JOHN & SAMUEL and their heirs all the lands I am now seized of body equally divided in quality and quantity at the time that SAMUEL shall arrive at his age of twenty one years, that they draw lots for choice unless they can otherwise agree.
Nevertheless it is my will and desire that my son JOHN after he comes of the age of twenty one years have liberty to live on and work a reasonable part of the said land until the division is to be made as aforesaid but it either of my said sons JOHN or SAMUEL before he arrives to the age of twenty one years and without heirs of his body then I give the whole of my said land to the survivors of any said Sons JOHN & SAMUEL and his heirs, and if both of them
shall die before Such age and without such heir, then I give my said land to be sold by my executors and the money arising by such sale to be divided equally among my daughters.
I give my still and worm and other appurtenances to my two sons JOHN & SAMUEL at the time SAMUEL shall arrive at the age of twenty one years, until such time I desire the same may be kept where they now are and used for the benefit of my estate.
I give to my son JOHN one negro named Sam to be delivered him at the time he shall arrive to the age of twenty one years. I also give my said son my gun and a horse a saddle and bridle and desire he may be furnished with one good suit of cloaths (sic) upon his arriving to the age aforesaid.
I give to my son SAMUEL my mulatto boy George to be delivered him at the time he shall arrive to the age of twenty one years at which time I desire he may be furnished with one good suit of cloaths. I also give my said son to be delivered at the time afresaid my sword now in possession of JOHN BATES. I also give him a horse, saddle and bridle. I having made some provisions for some of my daughters, I desire to make the other equal to them as follows, I give to my daughter FANNY PUTNEY one hundred pounds current money. I lend to my daughter JANE one negro named JUDE to be delivered to her at the age of twenty one years or day of Marriage and after the death of my said daughter I give the said and her increase after she shall be delivered as aforesaid to be equally divided among each of her children as shall be then alive or their legal representatives and if she shall leave no children then to be divided among my surviving daughters. I give my said daughter a horse saddle and bridle and one feather bed and furniture. I also give her one good suit of Cloaths upon her marriage or arrival to twenty one years of age.


I lend unto my daughter MARY my negro girl LUCE to be delivered to her at the age of twenty one years or day of marriage and after the death of my said daughter I give the said megro and her increase after she shall be delivered as aforesaid to be equally divided among such her children as shall be then alive or their legal representatives and if she shall leave no
children then to be divided among my surviving daughters. I give my said daughter a horse saddle and bridle and one feather bed and furniture. I also give her one good suit of Cloaths upon her marriage or arrival to twenty one years of age.
I direct that my executors shall purchase a negro girl nearly the age of my daughter ANN which negro I desire may be lent to my daughter ANN upon her marriage or her arrival at the age of twenty one years, and after the death of my said daughter I give the said negro and her increase after she shall be delivered as aforesaid to be equally divided among such her children
as shall be then living or their legal representatives and if she shall leave no children then to be divided among my surviving daughters. I give to my said daughter a horse saddle and bridle and a feather bed and furniture. I also give her one good suit of Cloaths upon her marriage or arrival to twenty one years of age.
It is my desire that all my negroes except what I shall hereafter give my wife be worked on any part of my land my Executors shall think proper until my children respectively shall have a right to demand such as are given and lent as aforesaid and that my children be supported as usual until they respectively marry or arrive to twenty one years of age. If any negro or negroes which I have before given or lent shall happen to die before the time possession of such negroe or negroes is or are to be delivered shall happen, it is my will and desire such negroe or negroes shall be replaced as near as can be of equal value out of my other negroes. I give to my wife one sixth of my slaves and personal estate to dispose of as she pleases in lieu of her dower and distributary share therein.
The increase of the negroes above lent which shall happen before the time they are to be delivered and also the residue of my estate I give after the legacies are paid to be equally divided among all my daughters or the survivors of them if no children of such shall die it is my will and desire that such of my children that shall not have sufficient schooling at the time of my death be sent to school and I desire my executors my (sic...?may) bind my son SAMUEL after he shall be well educated to some trade or calling the better to enable him to get a livelihood. It is my will and desire that my Executors may sell and dispose of any part of my
estate if they shall think it best so to do and also to purchase Slaves or any other thing they shall find needful for my estate. I appoint my friends JOHN NICHOLAS, WILLIAM CANNON, AND GEORGE CARRINGTON JUNIOR jointly severally Executors of this my last will and testamtne revoking all others before by me made. In Witness Whereof I have hereunto set my hand & seal the seventh day of March one thousand seven hundred and seventy nine.

At a Court held for Buckingham County the 8th day of April 1782 this will was proved by the oaths of Craddock Blanks and William Webb Senr two of the Witnesses thereto and ordered to be recorded and at another court held for the said county the 11th day of November 1782. This Will was sworn to by William Cannon one of the Executors herein named and on the motion of the said Executor who entered into and acknowledged a Bond with security according to law certificate was granted him for obtaining a probate thereof in due form.
