Voters delegates to the Constitutional Convention in 1795 included Caleb, William, Benjamin, Joseph, Francis, Samuel and John Higginbotham.


CONFLICT: In Name of Benj's Wife - the Correct name is Elizabeth GRAVES: Benjamin's wife listed as Elizabeth REID in some publications. the Allied Families section of, _THOMAS MAXWELL OF VIRGINIA AND GEORGIA AND HIS DESCENDANTS_, Annie Norman, Helen Maxwell Longino, and Annie Lou Maxwell, compilers, publ. by the compilers 1956. Many other sources give the name of Benjamin's wife as Elizabeth GRAVES, which is correct. These sources include The Higginbotham Family_, William Montgomery Sweeny, 1971, p.140 and _Higginbotham; Descendents of Moses and Frances (Kyle)_, Earl and Nena Higginbotham, 1989, p.23.


"The Sweenys pubished much of their early research on the Higginbothams in the Wm & Mary Quarterly magazines starting in 1917. They show his wife was Elizabeth REID. On page 140 of their book "The Higginbotham Family" the Sweenys show Benjamin's wife to be Elizabeth GRAVES.


In 1977 the Reverend Ralph Falls, then of Port Royal, VA, pub. the full text of the Rose Diary, with his own annotations on each entry. On pages XVIII through page XX he traces the history of the original diary right up to its present secure home in a vault at Colonial Williamsburg, Inc. Williamsburg, VA. Rev. Falls states "Parson Rose's original diary is in surprisingly good, legible condition after such an age - 226 years at this writing."


On page 97 of Fall's book (p 100 of the original diary) the following entry dated Feb 21, 1750/51 "Rain & Warm in ye Morning, cleared up in ye afternoon, cool, Married Benja Higginbotham and Eliza Graves, got home at night where found one George Damerel with his wife and a child brought to be christned - blowed hard."


Conclusion: Incorrect source showed REID as last name of Benj. wife.


Will of Benjamin, Sr recorded in Elbert Co. GA (Bk A of mixed records 1790-1800, page 8).
Mentions wife Elizabeth, four Negroes, the household furniture, the stock of cattle and hogs, and the crops that were on hand. To his daughter Ann he gave two Negroes. He gave a Negro to each of his sons, Caleb, William, Benjamin, Jr., Joseph and Francis. And the land he was living on to be equally divided between Joseph and Francis.


Execs: Elizabeth, William, Benjamin, Jr. Joseph and Francis, dated 9 Feb 1790, recorded 25 July 1791.


Prior to 1787 he acquired a considerable land holding around Elberton, Georgia, which was then located in the county of WILKES, and later, in 1790, became ELBERT county. "In his will......dated 9 Feb 1790 recorded 25 Jul 1791 Elbert (Book A of mixed records 1790-1800, page 8 - Elizabeth perhaps moved to TN along with her son William Higginbotham".


"6 Jan 1785 Amhst Co: Lemaster Cooksey of Amhst Co sold to Wm. Camden of Amhst Co for £70 170A on sout fork of Huff Creek, adjacent lines of Benj. Nowell, to top of a mountain, adjacent lines of Jno. Higginbotham, Benj. Higginbotham, and Patrick Nowell; witnesses were Jno. Watson, Wm. Tucker, Pledge Palmore, and Thos. Bailey "
