On Oct 10, 1709 he was Surety on a bond so he was an adult by
that time. By 1714 he was called Mr. signifying that he was a
man of standing. He acquired a large estate with considerable
wealth. His name appears in a number of legal instruments in
Essex Co. VA.
His will was witnessed by W. Roane, William Shelton, and John
Davis on Dec 3, 1746. Recorded in Essex Co. VA, BK 12, pg 225
and Probated Feb 19, 1750.
Bequeaths to:
John III - the plantation on which he now lives, 34 acres out of
the land I now live on and 250 acres out of the land I purchased
from Theodrich Bland.
Isaac, the plantation he now lives on and the land adjoining
laid off by Mr. Rogers as being part of the land I purchased
from Mr. Bland.
William, the plantation he now lives on and a parcel that is
laid off by Mr. Rogers that was purchased from Mr. Bland.
Richard, the plantation he now lives on and one half of the
stock of cattle, sheep, and hogs that is on his plantation.
Philip, my dwelling plantation with the appurtenances and all
land that I have not already given away.
Amie, one negro above seven years of age, one feather bed, two
cows and calves, three ewes and lambs, three dishes and half
dozen plates.
Winifret, one negro above seven years of age, one feather bed,
two cows and calves, three ewes and lambs, three dishes and a
half dozen plates. But in case either of my daughters, Amie or
Winifret, die without heirs, then their part will be divided
among my other daughters.
Catherine, my beloved wife, all the rest of my estate, real and
personal during her natural life and after her death to my
daughters, Mary and Catherine to be divided equally. Catherine:
The last name lacks proof; however all indications are that she
was Catherine Webb.

WILLIAM WITHERINGTON, JR. and wife, SARAH 'SALLY' STANLEY lived
in East Feliciana Parish from about 1809 until their departure
for Conecuh County, AL sometime about 1820. Following the war,
his family lived briefly in Feliciana Parish, LA about
1818-1820, before joining other Witherington family members in
Conecuh County, AL.
When the Witheringtons originally came to Conecuh County from
Louisiana (about 1819-1820), they lived on the Sepulga River,
where they built and operated a ferry. This area was very swampy
and most unhealthy. After several of the family, which consisted
of three generations, had died of the "fevers" (probably malaria
or typhoid), the land and ferry were sold and more land
purchased on higher ground, some of it was the present site of
the Witherington Farm on Alabama Highway 83 (near Lyeffion)."

Below is a transcription of a Photocopy of the Original Ensign
Commission of William Witherington, Jr. of Darlington District,
SC which was issued 7 July 1814 by the Governor of Mississippi.
William Witherington, Jr. was the father of John, James and
Augustus Levan Witherington whose families settled in Conecuh
County, Alabama and Union & Calhoun & Ouachita Counties,
Arkansas and whose descendants continue to be concentrated today
throughout the southern states. William Witherington Jr. was
the 4th Great Grandfather of William R. King, Jr. of Houston
who transcribed this commission from a photocopy of the original
document. June 26, 1999.

TO ALL WHO SHALL SEE THESE PRESENTS, GREETING
KNOW YE, That reposing special trust and confidence in the
patriotism, valor, fidelity and abilities of William
Witherington
I do appoint him an Ensign of the 17th Regiment Missippi
Territory, to take rank from the date hereof. He is therefore
carefully and diligently to discharge the duty of an Ensign by
doing and performing all manner of things thereunto belonging:
And I do strictly charge and require all officers and soldiers
under his command, to be obedient to his orders as an Ensign .
And he is to observe and follow such orders and directions from
time to time as he shall receive from the Governor of the
Mississippi Territory for the time being or the other superior
officers set over him according to the rules and discipline of
war. This commission to continue in force during the pleasure of
the Governor for the time being.
IN TESTIMONY WHEREOF,
I have caused these letters to be made patent and the seal of
the Territory to be hereunto affixed.
GIVEN under my hand at the Town of Washington.
The 7th day of July in the Year of our Lord one thousand eight
