my nephew & namesake Edward Mosby son of my brother Joseph R.
Mosby , the sum of one thousand dollars. The pecuniary legacies
I wish to be paid within twelve months after the day of my death
if convenient to my Exor. and without interest, But if not paid
within twelve months after my death then the same to be interest
after the lapse of twelve months until paid.
Authorises and empowers Executor to pay over legacy to Virginia
M. Quarles to her father or mother without requiring either of
them to qualify as Guardian of their said daughter;
and so far as to the thousand dollar legacy left to nephew
Edward Mosby; the receipt of the parents of either of the
parents in both cases shall be full protection & indemnity to my
Exor. without any guardianship in either case.
To Grandmother, Rebecca Winston, all the crops that may be
growing & not severed within the year in which I shall depart
this life. I also give & hereby reconvey to her the use of her
land & slaves for her natural life, to be held by her from and
after the close of the year in which I shall depart this life.
In order to enable her to prepare for succeeding crops. She
shall, free of costs & charges have the use of the hands,
plantation team & plantation implements to the close of the year
in which I die. All crops severed within the year of my death,
as to all livestock of any description and as to all kinds of
plantation implements, including wagons and carts. The whole
shall be valued and appraised by three of my disinterested
neighbors and shall be taken by said grandmother in fee simple
at such valuation and appraisement; and for the payment she
shall be required to give only such security as my Executors may
think proper to demand. This provision is to be regarded as
extending to provisions of all kinds for the use of a family &
plantation, in executing the same my Executor is hereby invested
with discretionary power.
Any money my brother Joseph R. Mosby shall owe me at the time of
my death, he shall hold the same provided that the interest on
the same be annually paid to my mother Eliza Mosby, during her
life.
Residue of Estate not herein specifically disposed of I lend to
my said mother during her life, at her death the same shall pass
in fee simple to my said brother Jos. R. Mosby, or to his family
according to the laws of distribution of Virginia , except that
I give to my said Mother in fee simple all my books my watch &
things to it belonging, also my furniture & wearing apparel of
all kinds provided she shall survive me. If she shall not
survive me then these last named articles shall go in fee simple
to my said brother Joseph R. Mosby, provided he shall survive
me, and if neither of them shall survive me then the same are to
be disposed of at the discretion of my executor.
Friend and relation Joseph K. Pendleton named executor without
security I confer upon him full, ample & discretionary powers,
to arbitrate, settle or give up as he may think proper in all
matters in which my estate may be concerned. In doing so, no
matter what the consequences may be, he shall not be held
personally responsible. I do not wish any Inventory or
appraisement made of my estate, except so far as the same are
provided for in relation to my said grandmother. Dated 26 July
1854 . Probated 13 November 1854 . Witnesses, Jos. W. Pendleton
, P. B. Pendleton. On 8 January 1855, Joseph K. Pendleton,
executor named in the will right to qualify and Joseph R. Mosby,
qualified as administrator with the will annexed, giving bond in
sum of $36,000 with John I. Quarles, Bickerston Winston, Wm. I.
Winston, and Richard C. Carpenter, securities. W. B. No. 13, p.
621.
Edward Mosby died 1854 willed to Grandmother Rebecca Winston,
all in Louisa Co. VA..
