    THOMAS BREASE, ELIZABETH TIMERTH. Theft: housebreaking, Theft: receiving. 29th June 1785 Reference Number t17850629-37 Verdicts Guilty; Not Guilty Sentences Transportation

    644. THOMAS BREASE was indicted for feloniously breaking and entering the dwelling house of Richard Plaistow , about the hour of eight in the afternoon, on the 12th of May last, no person being therein, and feloniously stealing therein one patent stove, value 30 s. and two china pedestals and vases, value 2 s. and two images, value 2 s. and one kitchen fender, value 5 s. his property . And ELIZABETH TIMERTH was indicted for feloniously receiving two china images, value 2 s. being part of the same goods, knowing them to be stolen . (The witnesses examined apart.)
    JOHN CAMMELL sworn. What is the prosecutor? - General Plaistow . I was charged with the care of the General's house; I saw the thieves go in and come out; I believe I was the last person that left the house, I am not sure, I double locked the door. Were there any children in the house? - No, the door was double locked the day before, I believe nobody was that day in the house but the thieves; on the Wednesday night I saw the prisoner Brease, and a chimney-sweeper go in without anything; the house has been inhabited by the General some time since, but there has been an action lately, and some things were there, they were General Plaistow 's: about half after eight, or within a few minutes, I saw a fellow with a porter's knot on his back, just opposite the General's door; then the prisoner came up soon after, and they walked into the house as regular as if they had a key, in three minutes they came out, and I seized the prisoner with a grate on his back; I do not know the name of them, I believe they are called patent stoves; I found this pick-lock key on the prisoner, which opens the door; the next day at the prisoner's lodgings, we found two china images at the lodging of the man prisoner; he said they were his, and the woman of the house told me so.
    HENRY CROCKER sworn. I am constable of St. Pancras, where this robbery was committed, I went to the lodgings of the man and woman prisoners, they both lodged together, when I came there, I found those two china images, they have been in Cammell's possession ever since.
    GEORGE BOYDEN sworn. I am watch-house-keeper, I produce these pick-lock keys.
    FRANCIS PLAISTOW sworn. I am the General's son, I have surveyed these images, and they are my father's property, I believe them to be his, I entertain no doubt about it: the stove is called a patent stove.
    WILLIAM COVENTEN sworn. I am a tripeman, I have known the prisoner Brease fifteen or sixteen years. What has been his general character the last year or two? - Very indifferent.
    RACHAEL SALISPURY sworn. I have but little to say about the fellow, but Betty Timerth I have known these twenty-three years. Court to Jury. Gentlemen , a dwelling house is within the intent and meaning of the act of parliament an inhabited house, it appears in evidence here, that the prosecutor had left this house, and left some furniture, but never had an intention of returning, so that if this house had been broke open in the night time, it would not have been a burglary, therefore you must acquit him of the capital part of the charge.
    THOMAS BREASE GUILTY of stealing . Transported for seven years . ELIZABETH TIMERTH , NOT GUILTY . Tried by the second Middlesex Jury before Mr. Justice HEATH.

    1526. THOMAS SORRELL was indicted for stealing, on the 26th of June , 1 hat, value 3s., and a bonnet, value 2s. , the goods of William Free .
    EMILY FREE . I am the wife of William Free - we live in Montague-street, Brick-lane . On the evening of the 26th of June, I had a hat and a bonnet, tied to a chair, in my little parlour, near the window, which was open - a person might have got them by opening the blind.
    CHARLOTTE KAYE . I live in Montague-street, and was looking into this shop window, because there was a room to let; I saw a young man put the blind open, and take the hat and bonnet out; he gave it to another young man - they ran down Brown's-lane; I am not certain that it was the prisoner.
    JOHN FREE. I was sitting on the counter, and heard an alarm, ran out, and the prisoner tapped me on the shoulder, and said, "It is of no use your going that way, they are gone this way."
    ROBERT DAVIS . I am an officer. On Monday, the 26th of June, between nine and ten o'clock at night, I saw a crowd of persons round the prisoner - I took him to a public-house - Charlotte Kaye came and said, (without hesitation,) he was the man.
    CHARLOTTE KAYE. I thought so then, but I do not think so now - no one has been talking to me about it.
    NOT GUILTY .

    JAMES WHITE was indicted for stealing, on the 4th of August . 5 handkerchiefs, value 10s. , the goods of Thomas Dexter .

    WILLIAM COVENTON . I am in the employ of Thomas Dexter - he is a pawnbroker , and lives in Whitechapel-road. On the 4th of August I saw the prisoner take these five handkerchiefs off the ground - I cannot tell how they came there; I had hung them up in the morning on a book, about two yards within the shop; it was between two and three o'clock; he stood just outside and reached in - he had not been in the shop; I followed him, stopped him, and asked what he had got in his hat - he said nothing. I told him a person had seen him put some handkerchiefs into his hat, and desired him to come back - he said he would; he turned, and came back a few steps - he then gave me the handkerchiefs out of his hat, and wished me to leave him - I said"No, I will take you back;" he kept dodging me about, and then ran away. I pursued, called for assistance, and some gentleman stopped him, and took him to my master's, who gave him in charge.(Property produced and sworn to.)

    GUILTY . Aged 30., Transported for Seven Years .
