Will for Peter Mauck - Frederick Co., VA Will Book No. 4 Page 87

In the name of God Amen. I Peter Mauk of Frederick County and the Colony of Virginia, being of weak body but well in mind and memory thanks be to God for it do make this my last will and testament Viz.
I do give and Bequeath unto my beloved wife Sennah the thrid part of All my Personal and moveable Estate. I give and bequeath unto my beloved son Frederick Mauk one hundred acres of the land joining Peter Spangler Line and Frederick Alturpher and Martin Black. I give and bequeath to my beloved son Andrew the plantation whereto I now live with the Improvements thereunto Belonging. I give and bequeath unto my son Henry the sum of thirty pounds currency to be paid him by Andrew out of said Plantation when he comes of age. I do allow my wife Sennah to live on my said plantation her life time without she marry and then if nothing be wasted till said Andrew comes of age. I do make my beloved wife sole Executrix and my beloved son John Mauk and my beloved freind Christopher Wandle overseers over my said estate that nothing may be wasted and that all my debts be paid before my estate be divided. In witness whereof I have hereunto set my hand and seal this first day of March, One thousand-Seven hundred and seventy one.

At a court held for Frederick Co. May 7th 1771. This last will and testament of Peter Mauk deceased was proved by oaths of witnesses thereto and ordered to be recorded and upon the motion of Sennah the Executrix therein named who made oath thereto certificate is granted her for obtaining a probate thereof in due form. She giving security whereupon she together with Abraham Benton and Conrod Slusher her Securities entered into and acknowledged a bond in the penalty of 300 pounds conditioned for due and faithful Administration of the said estate. 1.1.1.2 - Samuel Mauk m. Mary Polly Broyles. Sent on the Internet by George W. Durman - e-mail [email protected] "Samuel Mauk's wife seems to have been known by two names. Her grandson, Capt. Ross Smith, b. 1846, in his book Reminiscence of an Old Timer, published 1930, says on pg. 4 that his grandfather Samuel Mauk married Sarah Broyles. Ross's sister, Mrs. Ellen Smith of Corbin, KY, likewise insisted that their grandmother's name was Sarah Broyles. On the other hand, in his will, James Broyles calls his daughter Polly Mauk and leaves 50 acres to her husband, Samuel Mauk. In the 1850 census, Samuel Mauk's wife is given as Mary Mauk, age 55. Many of her descendants gave her name as Mary. It seems likely, therefore, that her name was Mary Sarah or Sarah Mary and her nickname was "Polly".

I, Abraham Mawk, of the County of Washington and State of Tennessee do make, ordain and
publish this as my last will and Testament, hereby revoking and making void all other wills
by me made. - I will and bequeath to my three brothers Montgomery Mawk, Jacob Mawk, and Embree
Mawk my undivided half as moiety in the forge mill and the lot whereon James M. Mawk now lives,
being the old stone house lot, including all the land conveyed from Montgomery Stuart? to
James M. Mawk and myself jointly and from Julius Broyles to James M. Mawk and myself jointly, my
interest in the same to be [and not] to the benefit of the paid Montgomery Mawk, Jacob Mawk and
Embree Mawk, their heirs and assigns, forever.

Lastly, I hereby nominate and appoint James M. Mawk and W. H. Smith, Executors of this my last will
and testament. In testimony whereof I have herunto set my hand and seal this 28th day of September 1846.
