The Barry County Circuit Court convened Monday with Judge F. C. Johnson, Prosecuting attorney, Jas. Talbert; Circuit Clerk, Jams Manning, Court Stenographer, Bert Dummit; Sheriff, M. W. Newman and Deputies S. M. Trolinger, S. R. Reynolds and Darb Henley, present.

First National Bank vs. Bank of Exeter, action for money paid to forged check; cause dismissed by plaintiff, each party to pay costs made by each party.

Lee Moore vs. St. L. & S. F. R. R., damage, dismissed.

Hiram Hayes, et al vs. Loren Hayes, et al, to set aside will; bill of exception produced, signed and ordered filed.

City of Monett vs. W. S. Heath, appeal; dismissed by plaintiff.

City of Monett vs. Joe Kennedy, appeal; motion to quash sustained.

W. H. Trent vs. W. J. Buleyand Sam Leonard, appeal on bond; continued by agreement.

W. S. Heath vs. G. B. Martin, dismissed by plaintiff.

W. S. Heath vs. G. B. Martin et al, security for cost; same.

The Chicago Projecting Co., vs. S. D. Shipley et al, action on contract; cause continued.

E. B. Downer vs. George Greathouse, damages; continued.

Rhoda E. Adams vs. Frisco R. R. Co., damages; judgment for plaintiff for $1,250.

W. J. Fleming vs. St. Louis R. R. Co., damages; dismissed by plaintiff.

Claud Callis, an infant, by J. H. Callis, next friend & J. H. Calls, plaintiff, vs. St. L. & S. F. R.R. Co., damages, trail by court for plaintiff for $100.

State vs. Wm. Bowman, breaking jail; continued.

State vs. Joe Fields, breaking jail, continued.

State vs. Dillard Whisman, et al, disturbing religious worship; will and Chas. Burris plead guilty and were fined $5.00 each.

State vs. Roscoe Call, et al; indictment quashed.

State vs. Harry Westbay, forgery in first degree, nolled.

State vs. Westbay, embezzlement; nolled.

State vs. J. V. Meagher, selling liquor on Sunday; death of def't., suggested, cause dismissed.

State vs. J. V. Meagher, giving liquor to minor; same as above.

State vs. F. N. Reese, violating drug law; motion to quash indictment, sustained.

State vs. B. W. Miller, burglarizing dwelling house, motion to quash indictment sustained.

State vs. A. F. McRay, violating local option law; nolle.

State vs. Joe Clontz et al, assault and battery; state dismissed as to Earnest Clontz; def't. Joe and Bud Clontz plead guilty and were fine $10.

T. M. Allen vs. Margaret Allen, divorce; demurrer filed and over ruled.

Jerry Murphy vs. A. C. Hartman, trail by jury and verdict for defendant.

Arthur and Ambrose Black vs. W. E. Marion, on contract; trial by court and judgment for plaintiff for $05.

Elmer Bolton vs. John T. Marbut and D. E. Walker, action on note; continued by agreement.
