History of Tompkins Co., NY, p. 519: The Methodist Church at Ludlowville: In 1810 the Genesee Conference was formed. William Case, presiding elder of Cayuga District, afterwards known as the "father of Indian Missions in Canada," ANNING OWEN, ... and others.

Ibid, p. 529: Religion--As early as 1816 a class was formed in the Seabring neighborhood, and that a similar organization existed in the village of Newfield one year later. Preparatory meetings had been held by a Methodist itinerant by the name of ANNING OWENS, some fifteen years previous to the actual formation of the class.

A REV. WAR VET. He left no children. His will of 23 Feb 1832, proved 25 Mar 1834, Tompkins County, NY, Surrogate's Court, Ithaca, NY, Will Book C, p. 94. Will contested by Thomas OWEN, son of Israel OWEN, on 14 Apr 1859, about 25 years later, on behalf of other next of kin. Mowbray's will originally left money to the Methodist Episcopal Church, but later it was awarded to "next of kin" Elizabeth Shaw, Christina Hartsough, Mary Manning and Sally Oldfield.


Will of Mowbary [sic] OWEN:


At a Surrogate Court held for the County of Tompkins at the Office of the Surrogate of said County in the Village of Ithaca on the 25. day of March 1834, Present. Eans? Humphrey, Surrogate

Mary Owen Executrix and Thomas Bishop and George Emmens Executors named in the last Will and Testament of Mowbary [sic] Owen late of the town of Lansing deceased appeared for the purpose of having the said Will proved and recorded according to Law and made satisfactory proof that notice of this application had been served according to Law ?on an? the His? of said deceased.

An instrument purporting to be the last Will and Testament of Mowbray OWEN bearing date the thirteenth day of February in the year 1832 was produced in Court, And shewn to each of the witnesses as hereinafter mentioned. The said Will is in the words and figures following Viz:

In the name of God Amen

I Mowbay [sic] Owen of the town of Dryden and County of Tompkins being of sound disposing mind and memory belessed by Almighty God for the same do make and publish this my last Will and Testament in the words following to wit:

First--I order and direct that my Executrix and Executors hereinafter named pay all my just debts and funeral charges out of the first moneys coming into their hands after my decease--

Secondly I order and direct that as soon as may be convenient after my decease that my executrix and Executors dispose of all my real and personal property at public auction or otherwise at such time or times and on such terms as to them shall appear most advntagious to my said estate.

Thirdly, I give and bequeath to my beloved wife Mary one third part of all my estate both real and personal (or the Moneys that may arise from the Sale of Same) after paying my just debts and funeral charges as above in lieu of Dower.

4th I give and bequeath to my newphew Steven Jane of the County of Steuben the sum of one hundred Dollars.

5th I give and bequeath to Anna Mackey wife of Jeremiah Mackey of the County of Ulster Fifty Dollars.

6th I order and direct that all the residue and remainder be put to Interest secured by bond and mortgage or otherwise as my said Executrix and Executors may think proper from time to time during the natural life of my said wife Mary; And I further direct that the interest arising from the same be paid to her the said Mary as fast as the same shall come into the hands of my said Executors for her benefit and support and to be disposed of at her discretion.

7th I give and bequeath all the residue of my said estate after the death of my said wife Mary to the Methodist General American Missionary Society appointed to preach the Gospel to the poor, ?etc.?

Lastly-I nominate and appoint my beloved wife Mary Executrix and my trusty friends Thomas Bishop of the town of Lansing and George Emmens of the town of Dryden Executors of this my last Will and Testament--hereby revoking all former Wills by me made--In Testimony whereof I have hereunto set my hand and seal this thirteenth day of February in the year of our Lord One thousand eight hundred and thirty two. /s/ Mowbray Owen

Smith Head Jr. of the town of Dryden in the County of Tompkins being first duly sworn deposeth and saith that he was acquainted with the above mentioned Mowbray Owen deceased in his life time--that he saw the said Mowbay Owen deceased subscribe the Instrument--now shewn to this deponent--purporting to be the last Will and Testament of the said Mowbay Owen and above described that he heard the said Mowbay Owen declare the same to be his last Will and Testament--that this deponent subscribed his name as a Witness in the presence and at the request of the said Mowbray Owen--that the said Mowbray Owen was at the time in the opinion and belief of this deponent of sound mind and memory and not under and restraint--and that he was about eighty years of age--That he died on or about the fourth day of January in the year 1834 and was a resident of the town of Lansing in the County of Tompkins at the time of his death. /s/ Smith Head

Smith Head of the town of Dryden in the County of Tompkins being first duly sworn deposeth and saith--that he was acquainted with the above mentioned Mowbary Owen deceased in his life time, that he saw the said Mowbary Owen deceased, Subscribe the instrument now shewn to this deponent purporting to be the last Will and Testament of the said Mowbay Owen and above described that he heard the said Mowbay Owen declare the same to be his last will and Testament--that this deponent subscribed his name as a witness thereto in the presence and at the request of the said Mowbay Owen--that the said Mowbay Owen was at the time in the opinion and belief of this deponent of sound mind and memory and not under any restraint--And that he was about eight years of age, that he died on or about the fourth day of January in the year 1834 and was a resident of the town of Lansing in the County of Tompkins at the time of his death. /s/ Smith Head

The forgoing proofs and examinations taken before me the Surrogate aforesaid and at the time and place first mentioned and the depositions of the respective witnesses were by them respectively subscribed after having been carefully read over to them. And I the said Surrogate being Satisfied when said proof taken that the said will will duly executed-- that the said Testator at the time of executing the same was in all respects competent to devise real estate and not under restraint--do therefore allow the said Will proofs and examinations to be recorded. The petition of THOMAS OWEN of Southport, Chemung Co., NY respectfully shows that the said MOWBRAY OWEN as he is informed & believes died in the Town of Lansing in the County of Tompkins in the year 1834. That upon the accounting of Thomas Bishop Esq surviving Exor of the last will of said Dec'd there was a sum of money found remaining in his hands which being claimed by the Methodist Episcopal Miss. Soc'y under the said will and by the next of kin of said Dec'd the Court of Appeals finally decided that the said next of kin were entitled to the same and that the costs & counsel fees should be paid out of the fund except the costs of the next of kin in the Court of Appeals which were directed to be paid by the Miss. Soc'y. That after deducting and paying such costs and counsel fees there remained the sum of $1026.94 to be distributed among the next of kin.

Your Pet'r further more on information & belief that afterwards and in or about the 17th day of April 1857 a Decree or order was duly retrieved by the Surrogate of said County by which the same was directed to be paid to ELIZABETH SHAW, CHRISTINA HARTSOUGH, MARY MANNING & SALLY OLDFIELD their attys or assigns in equal portions being $256.73 to each. And that said decree provided that, in as much as it was suggested the names, numbers & degree of the next of kin of said Dec'd might not all be certainly known the said ELIZABETH, CHRISTINA, MARY & SALLY their attorneys or assigns should file or cause to be filed in the office of the Surrogate their bonds as therein directed conditions to pay back to the said Court or to such person or persons as the Court should direct such sum or sums as should be necessary to make a first distribution among all who might be found entitled as or under the next of kin to said Dec'd.

Your Pet'r further shows that the said ELIZABETH, CHRISTINA, MARY & SALLY are not the only next of kin of said Mowbray Owen Dec'd but that the Dec'd had FOUR BROTHERS and TWO SISTERS all of whom died before the said Mowbray and whose names were: TIMOTHY OWEN, JOHN OWEN, ISREAL [sic] OWEN, ANNING OWEN, brothers, and MRS. NATHANIEL JAYNE AND MRS. SAMUEL GUSTHIE [GUSTRIE?] those being the names of their husbands--sisters MRS. GUST___'S name was RUTH & MRS. JAYNE'S name was ELIZABETH. That your Pet'r is informed and believes that all these brothers and sisters died before the said Mowbray. And that there are descendants of such Brothers & Sisters entitled to share in the fund aforesaid as next of kin of said Dec'd under such next of kin as follow to wit:

Descendants of the said TIMOTHY as follows: TIMOTHY OWEN of Hector, NY; MARY STRADER wife of JACOB STRADER of Watkins, Schuyler Co.; RACHEL widow of ANDREW J. SMITH, dec'd of Bennettsville [sic] Hector; LYDIA wife of AARON [sic] M. COON of Hector; SALLY wife of HARRY SCOVILLE residing in Wisconsin or Iowa who are the children of MOWBRAY OWEN 2ND a son of said TIMOTHY who died in Hector about the year 18__; and JOHN M. OWEN, HORACE M. OWEN, ERMINDA wife of JACOB SMITH, EMILY OWEN said ERMINDA and EMILY being minors--children of DANIEL OWEN as son of the said MOWBRAY OWEN 2ND who died before his father all of Hector, NY. SALLY OLDFIELD wife of JESSE OLDFIELD of Christri (?) [sic] Orange Co., NY daughter of said *TIMOTHY MANNING [sic * see note below] widow of ISAAC MANNING Dec'd of Ithaca, NY also a daughter [probably Mary OWEN, wife of Isaac Manning--jms]. [* Possible mis-print? It should it be Timothy OWEN? -jms]

Descendants of the said JOHN as follows to wit: DANIEL OWEN of Goshen, Orange County, NY; FANNY wife of JOHN J. PAPINEAU [note: desc. of John Pappino, Rev War Major] of Goshen aforesaid; PRISCILLA wife of SAMUEL S. MILLSPAUGH near Penn Yan Yates Co., who are children of ARCHIBALD OWEN a son of said JOHN and who died after the Testator; the heirs of JOHN OWEN JR a son of said John who died in Ohio but your Pet'r does not know whether he left widow or children. He had been married; SALLY widow of GEORGE CARR Dec'd of Port Byron, Cayuga County, NY daughter of said JOHN; JULIA widow of JAMES CARPENTER Dec'd of Lockport, NY a daughter of said JOHN.

Descendants of the said ISRAEL [sic] as follows to wit: son THOMAS (your Pet'r) of Southport, Chemung Co., NY; daughter SALLY widow of THOS WRIGHT of Wells, Bradford Co., PA; ELIZABETH wife of NATHANIEL ROE of Warwick, Orange Co., NY; ESTHER wife of JAS GORDON of Wells, Bradford Co., PA.

Descendants of the said ANNING as follows: Daughter ELIZABETH widow of JOHN SHAW who died within 5 or 6 years of Ithaca, NY; CHRISTINA who married ANGLEBART B. HARTSOUGH, Newfield.

Descendants of MRS. NATHANIEL JAYNE sister of Dec'd who died in Town of Vernon, N. Jersey. Left son STEPHEN JAYNE stated in the will of Testator to be of Steuben County. Don't know of any other children of heirs nor whether he is living.

Descendants of MRS. SAMUEL GUSTRIE (?) sister of Dec'd who died in Warwick, Orange Co., NY; THOMAS, SAMUEL, JANE sons & daughter; widow POLLY of JESSE a son of MRS. G's (Mrs. Samuel Gustrie); 2 sons and 2 daughters names unknown of JULIA WOOD wife of DANIEL WOOD a dec'd daughter of said JESSE, one of whom is of age and the other minors. The said THOS, SAMUEL & JANE live in Troy, Bradford Co., PA as also the widow POLLY and the 2 sons and 2 daughters of JULIA WOOD, Dec'd; BENJAH of Troy [NY] aforesaid son of DAVID and a dec'd son of MRS. G[USTRIE] and 2 sons & one daughter of THOS H. GUSTRIE (?) [almost looks like "Guthrie"] Dec'd a son of DAVID dec'd son of MRS. G[USTRIE].

Your Pet'r shows that he hath no further knowledge or information as to the names number degree or places of residence of such next of kin etc than as aforesaid. And your Pet'r shows, as appears above that he is a son of ISREAL [sic] OWEN a Dec'd brother of MOWBRAY OWEN Dec'd & that he has authority by powers of atty from SALLY WRIGHT, ELIZABETH ROE, and ESTHER GORDON his sisters and with himself all the next of kin of said ISREAL [sic], to receive their shares for them. He is advised that each of such share amounts to about the sum of $42.74 with such interest as may be lawfully due them subject to such charges and fees of the Surrogate & others as may be just. Your Pet'r prays that such proceedings may be had that a decree of the Hon Court may be duly made & entered for a redistribution of the fund aforesaid to the end that those who are entitled to any portion thereof may upon due proof of their right to share therein and the extent thereof be paid their several portions of said fund after deducting such charges and fees of the proceedings as may be just & your Pet'r will same pray etc.

History of Tioga, Cayuga, Tompkins, etc., p. 623: Hector, Peach Orchard, etc. Peach Orchard was located near Reynoldsville, near Hector, in Schuyler Co., NY. ...In 1813 there were little patches cleared at the following places, between Reynoldsville and Peach Orchard... Daniel Everts was living on the southeast part of lot no. 32...Jacob Hagar was located at the present residence of his son-in-law, A. C. Tracy. His brother, Peter Hagar, had a house in the fields east of the present road... further south were Jabez Smith, Brickley Monell, Wilcox Buckbee, and MOBRAY OWENS.

18. Sarah OWEN b. 1755, Goshen, Orange Co., NY. 25 Not mentioned in the Petition against Mowbray Owen's estate. She may have died young.

19. Elizabeth OWEN b. 1757, Goshen, Orange Co., NY 26 m. Nathaniel JAYNE, resided: Vernon, Sussex Co., NJ. Elizabeth died bef. 1859, Vernon, Sussex Co., NJ, resided: Vernon, Sussex Co., NJ. Nathaniel: Vernon, NJ is located just across the state line from Warwick, Orange Co., NY.
