Cumberland County registry of deeds

 

1950’s - there was a  dispute concerning the boundaries of several lots in the fourth division of lands in Windham.  The Historical Society does not have the papers concerning this dispute; however  loaned letters makes reference to many of the owners of same, (and surrounding properties) giving the Deed and Page number as recorded in Cumberland County registry of deeds.  Following is a list of those names & deed references to aid further research at the Registry of Deeds.

 

28 Jul 1819 – Book 281 Page 422 -Henry MOORS to John VARNEY describes the property as lot 62 in the 4th division containing by estimate 73 acres in the whole lot more or less.

 

27 Aug 1832 – Book 285 Page 270, Warranty Deed - John VARNEY to Joseph HAWKES Jr., land in Windham, being a part of lot 62 in the 4th division, containing five acres and 100 square rods.

 

11 Mar 1835 – Book 140 Page 565, Warranty Deed – Levi STEVENS to John FOSTER, fifty acres of lot No. 61 in the 4th division of land in Windham.

 

5 Feb 1840 – Book 175 Page 160, Warranty Deed – John FOSTER to Benjamin MORSE Jr., same description as deed Book 183, Page 492, “and as follows:  beginning at the west corner of lot numbered sixty-One in the fourth and last division of lands in Windham; thence running Southeast to a town road, thence running northeast on the line of said road to land owned by said Jacob ALLEN; thence running Northwest to the North corner of said lot; thence running Southwest to the first bounds mentioned at the west corner of said lot, containing forty acres, more or less.”

 

12 Oct 1843 – Book 183 Page 492, Warranty Deed – Benjamin MORSE, Jr. to Jacob ALLEN, same description as deed Book 175, Page 160.

 

23 Dec 1857 – Book 285 Page 419, Warranty Deed - John VARNEY to Margaret GRAFFAM, all of lot #62 in the last division of land in Windham, except 5 acres and 100 square rods sold to Joseph HAWKES, being the same land on which I now live.  Also 10 acres which I own in lot 46.

 

12 Jun 1858 – Book 287 Page 462, Warranty Deed -John GRAFFAM and Margaret GRAFFAM to Jeremiah HAWKES, part of lot #62 in the 4th division, containing 16 acres and one-fourth. Mentions William KNIGHT, neighboring land owner.

 

22 Dec 1858 – Book 293 Page 29, Warranty Deed – John VARNEY to William A. LAMB, part of Lot #61 in the 4th division of lots, containing twenty acres; being the same Levi STEVENS sold to VARNEY by deed dated 14 May 1831.

 

27 Jun 1861 – Book 309 Page 147, Warranty Deed -Margaret GRAFFAM to Alley HAWKES, part of lot 62 in the 4th division.  Mentions neighboring land owners; Ezekiel VARNEY Jr., William W. STROUT and Joseph HAWKES.

 

12 Oct 1861 – Book 309 Page 567 Warranty Deed – William A. LAMB to Moses HUNT, part of lot #61 in the 4th division of lots.  Mentioned neighboring land owners; Margaret GRAFFAM, Mr. BARNEY and Reuben ALLEN.

 

3 Feb 1864 – Book 330 Page 18, Mortgage - Margaret GRAFFAM to ROGERS and VARNEY, description includes all of Margaret GRAFFAM’s property. This mortgage is not discharged.

 

15 May 1865 – Book 335 Page 62, Mortgage - Margaret GRAFFAM to Z.L. WHITNEY & Co., all of lot 62, last division in Windham. This mortgage is not discharged.

 

31 Dec 1865 – Book 365 Page 442, Warranty Deed – Charles ROGERS and Henry H. BOODY to Oliver POPE, part of lot 62 in the 4th division, containing 40 acres more or less.  Mentions neighboring land owners; Elijah KENNARD, Jacob WARD, William A. LAMB, Alla HAWKES, Mark JORDAN, and Henry McDONALD. 

 

14 Jul 1866 – Book 362 Page 140, Sheriff’s Deed – Margaret GRAFFAM to Oliver POPE – All her equity of redemption above mortgages; recorded in Book 330 Page 18 and Book 335 Page 62.

 

14 Jan 1867 – Book 343 Page 469, Quit-claim Deed – Jacob ALLEN to Alvin ALLEN, same as deed Book 175, Page 160, except bounded on northeast by William H. ALLEN.

 

[No date] – Book 417 Page 114 and Book 476 Page 73, Mortgages given by Alvin ALLEN that are not discharged of record.

 

5 May 1873 – Book 418 Page 110, Warranty Deed - Oliver POPE to William H. ALLEN, practically same description as above deed Book 265, Page 442.  

 

5 May 1873 – Book 397 Page 280, Mortgage - William H. ALLEN to Heziah H. BROWN, this mortgage was not discharged. 

 

27 Mar 1875 – Book 414 Page 389, Warranty Deed – William A. LAMB to William H. ALLEN Jr., land in Windham, containing sixteen acres more or less; being the same LAMB bought of John VARNEY except a piece sold to Moses HUNT.  Mentioned neighboring land owner, Elbridge ALLEN.

 

10 Sep 1881 – Book 477 Page 481, Decree -William H. ALLEN to Charles JONES, this is a decree or writ of entry under which JONES get possession.  Decree rendered at April term of the Supreme Court 1881.  Same description as deed Book 418, Page 110.

 

14 Mar 1887 – Book 535 Page 68, Warranty Deed - Alley HAWKES to Fred W. ALLEN, same description as deed Book 309, Page 147, except now mentions Nathan STROUT.

 

11 May 1889 – Book 561 Page 179, Warranty Deed - William H. ALLEN to William E. BERRY, “a certain lot or parcel of land situated in windham it being a part of lot 62 in the fourth division of land in Windham and bounded as follows, to wit, beginning at a stone post in the line of the road leading from Nathan STROUT’s house by Elbridge ALLEN’s house, thence North forty-one and one-half degrees West to the side line of lot No. 46, thence South forty-nine and one-half degrees West twenty rods to a stone post marked 46, thence North sexty-seven degrees West to the shore of the Collins Pond, so called, thence southwesterly by the shore of said pond to Fred W. ALLEN’s land, thence southeasterly on the line of Fred W. ALLEN’s land to the road, thence northeasterly on the line of the road to the first mentioned bounds containing fifty-five acres, more or less.”  [the writer of the letters from which this data is extracted goes on to say, “The words in the above ‘it being a part of lot 62’ are an error.  It would seem that the ‘stone post marked 46’ in the above must be the northerly corner of Lot 62 and the westerly corner of Lot 61.  The above is perfectly clear when you read other deeds in the chain.”  The deed in Book 285, Page 419, “conveyed all of lot 62 to Margaret GRAFFAM, from John VARNEY 12/23/1857.”  No record found “that she owned any part of lot 61 on the northwest side of the road.  The easterly part of the lot became the property of Oliver POPE and was conveyed to William H. ALLEN” by deed 5/5/1873 Book 418, Page 110.]

 

8 Jun 1889 – Book 567 Page 237, Warranty Deed - William E. BERRY to Herbert R. MORTON, part of lot 62, 4th division of land in Windham, containing 13 acres and 44 square rods.  Neighboring land owners; Fred W. ALLEN, Nathan STROUT, and Elbridge ALLEN. 

 

24 Jun 1890 – Book 567 Page 252, Warranty Deed - Herbert R. MORTON to William MANCHESTER, same description as deed above Book 567, Page 237. 

 

21 Nov 1891-Book 586 Page 296, Warranty Deed – Alvin ALLEN to Edward A. SPARKS- Land in Windham bounded & described as follows, to wit; beginning at the west corner of land #61 in the 4th and last division of lots in Windham; thence running southeast to the town road leading from Dolley’s Corner, so called, to Nathan STROUT’s; thence northeast on the line of said road to land of Edwin G. HALE; thence running northwest to the north corner of said lot #61; thence running southwest to first mentioned bounds, and containing 40 acres, more or less.

 

21 Nov 1892 – Book 596 Page 318, Warranty Deed – Edward A. SPARKS to Mary E. LIBBY- Same description as Book 586, Page 296.

31 Jul 1905 – Book 773 Page 134,  Warranty Deed - Mary E. LIBBY to Morris TAYLOR,– Parcel 1, same description as Book 586, Page 296.  Parcel 2, part of lot 62 in the 4th division of Windham, containing 13 acres and 44 square rods, reference Book 688-140.

 

20 Oct 1905 – Book 776 Page 105, Warranty Deed - Morris TAYLOR to Celia TAYLOR – Parcel 1, same description as Book 586, Page 296.  Parcel 2, same description as Book 773, Page 134.

 

 

22 Jan 1906 – Book 785 Page 283, Warranty Deed - Celia TAYLOR to Mary E. HAYDEN, parcel 2. Part of lot #62 in the 4th division of Windham, containing 13 acres and 44 square rods.  Parcel 1. Land and buildings in Windham being the same conveyed to Morris TAYLOR by Mary E. LIBBY by warranty deed dated July 31, 1905, Book 773, Page 134, and later conveyed by Morris TAYLOR to his wife, Celia TAYLOR, this being a part of lot 61 of the 4th and last division of lots in Windham.  Mentions neighboring land owners home estat of Nathan STROUT’s heirs, Edwin C. HALE, and road leading by Dolley’s Corner. Containing 40 acres more or less. 

 

10 Nov 1909 – Book 849 Page 363, Warranty Deed - Sarah E. BERRY to Fred W. ALLEN, same description as Book 838, Page 329 and reference to it for title.

3 Oct 1952 – Book 2207 Page 257, Quit-claim no cov. [recorded 19Jan1955] – Margaret J. JONES to Jones Construction Comp., same description as Book 2117, Page 249.

 

11 Nov 1952 – Book 2112 Page 59, Warranty Deed – Jones Construction Comp. to George A. BROOKS and Dorothy A. BROOKS, part of lot #61 in the 4th division of lots in Windham.  Mentions neighboring land owners; home estate of Nathan STROUT’s heirs, Edwin C. HALE, and road leading by Dolley’s Corner.  Containing forty acres, more or less. [per writer of letters, from which deed information extracted, “chain of title was searched, and no deed was found that brought more than the original fifty acres of lot 61, described in Book 140, Page 565, into the chain.  The deeds in this chain consistently call for forty acres of land on the northwest side of the road in lot 61.  Actually there would have been nearer 56 acres of land in 61 on that side of the road.  The words in (Book) 175 (Page) 160, ‘Beginninging at the west corner of Lot 61’ must be in error.  The words ‘beginning at the west corner of lot 61’ are repeated in the deeds in this chain from 1840 down to Brooks’ deed, but since the owners in this chain did not own to the west corner of Lot 61, and apparently did not claim to it on the ground, the mere fact of the repition in the deeds would not improve their title.” ] [See statement following deed entry 21 Jan 1953 Book 2117 Page 249]

 

21 Jan 1953 – Book 2117 Page 249 – Jones Construction Company to Earl BRAND – a certain lot or parcel of land located in the Town of Winham, being on the Varney Mill Road and being part of lot 62 in the 4th division of lots, containing thirteen acres, more or less.  Being the same premises deeded to this grantor by Margaret J. JONES also being part of the premises deed to Margaret J. JONES by one Lawrence P. DYER.

 

[Per writer of letters from which all of the above deed data extracted, “In spite of the confusion in describing the lots in which the land in question lies, I think the parcels have retained their identity, the BROOKS piece being the portion of (Book) 140, (Page) 565 on the northwest side of the road; and the BRAND piece being the southeast portion of (Book) 561, (Page) 179 with about 20 rods of the frontage in Lot 61, and about 39 rods of the frontage in Lot 62.
