Ever since the U.S. signed the Berne Convention and enacted supporting legislation in 1988, copyright notices and registration are no longer required to receive copyright protection. In most cases, no copyright notices appear on this site. However, copyright protection still subsists for this site.

This site contains images and data that are afforded copyright protection as indicated by the preceeding paragraph. In general, the images and data which are indicated as belonging to a "Collection" are afforded copyright protection to the person associated with that collection. If you desire to copy or use any images or data that are associated with a "Collection" please get permission from the proper person as indicated in the Contributers and Researchers page. If you are unable to contact that person or if no such person is listed, or if the images or data are not associated with a "Collection", please contact me, [email protected], and if it is within my power I will most likely grant permission for non-commercial purposes.

Genealogy and "Fair Use"

Many aspects of private genealogy research falls under the "Fair Use" provision of the Copyright Law which I have provided here for your reference:

S 107. Limitations on exclusive rights: Fair use

Notwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include-

(1) the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;

(2) the nature of the copyrighted work;

(3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and

(4) the effect of the use upon the potential market for or value of the copyrighted work.

The fact that a work is unpublished shall not itself bar a finding of fair use if such finding is made upon consideration of all the above factors.



About PhotoWebMaker

    PhotoWebMaker is a not-quite-ready-for-prime-time program that has been a spare time project of mine since the fall of 1997.  Originally it was created simply as a means to organize, preserve, and share family pictures amongst the McGee family.  This program might provide an easy way to hyperlink and map photographs and other items through a number of individuals in a gedcom file. There are a number of problems with the output of  PhotoWebMaker, but I thought that the site might be useful in spite of all the shortcomings.
