All other wills void. All debts and funeral expenses to be paid out of the estate.
1st. To wife Polly Lanham, during her life one-third of all the personal estate, also the use and benefit during her life of all the tract of land where testator lived, supposed to contain 163 acres, known as the Wilson Tract, in lieu of dower, it being of greater value than the one-third part of all the real estate.
2nd. To son(s) Matthew R. Lanham, and Charles T. Lanham, the boundry of land on which they now live, lying on the waters of Claybrook Branch and Deepturn Branch in the lower Flatswoods of Pocatilico[sic] River in Kanawha County. Each of them is to have the boundries survey to them by Hezekiah Agee. But they, Matthew R. and Charles T. Lanham, shall pay $50.00 fifty dollars each to daughter Mary Jane Bailey before the entire title to said land shall be fully their own. Then the said land to be all their share in the estate.
3rd. To four grandchildren, heirs of daughter Elizabeth Martin, deceased, $5.00 five dollars each out of the estate.
4th. To daughter Mary Jane Bailey, the $100.00 as provided in the 2nd clause. Also $100.00 additional if that sum remains after complying with the foregoing bequests.
5th. To the nine children, five sons, four daughters, namely; James Lanham, William R. Lanham, Joseph N. Lanham, Henry C. Lanham, Christopher C. Lanham, Luticia Melton, Lucinda Melton, Serena P. Caruthers and Caroline EE. Caruthers. Jointly and equally in fee simple and forever the 163 arces of land more or less, known as the Wilson Tract, it being land bequeathed to wife Polly during her lifetime, and not to take effect until after her death. Also the nine children mentioned above to have the remainder of the money and other personal property of any remains after all debts, charges of.
