The new coutroom under the Town Hall was filled to overflowing, last Saturday morning, to hear the case of James Roach and James Henderson, charged with assaulting Mr. Addison Brooks. Mr. Brooks testified to the facts mainly as they appeared in our last issue; Dr. Harris described the wounds on Co. Brooks' head and testified as to his physical condition when called to attend him, and during the following week. Mrs. Brooks gave some testimony as to the time her husband left home, and of his return, and also his condition on returning.

The defense seemed to confine themselves to proving that the assault was not committed with a hoe, and that Col. Brooks' condition was not such as the prosecution had stated. There was no evidence that James Henderson took any part in the assault, and he was discharged. Roach was adjudged guilty, and bound over in the sum of $500, to appear before the Grand Jury. His father and Mr. Owens furnished the necessary bonds, and he was released.

One of the witnesses for the defense made some amusement by testifying as to the time Mr. Brooks was seen up town, on the evening of the assault. He was easily proven to have made a mistake as to the time. The case of the government was well sustained by Chas. H. Hudson, Esq., of Somerville, and the defendant could certainly find no fault with the manner in which his interests were looked after by Joseph Holt, Esq., of Cambridge. The hearing occupied nearly the entire forenoon.
