There is a fragment of a will at the Essex Record office which dates from the 1530's which mentions Thomas Legat as the executor, however, the testator's name is missing.(1) Thomas Legat senior is also mentioned in a grant dated 1 Jan. 1530 concerning a tenement at Okehylle in Havering and other property.(2) How Thomas is related to our Legates is unknown at this point.

Richard was a farmer in Theydon Garnon and had a house and land copyhold from John Foster.

All Saints Church- Theydon Garnon

In his will 14 Nov. 1559 Richard gave his wife Susanna all the property she brought into the marriage if she would discharge the executors of all debts due and expressed in her late husband's (Harry Tod's) will. He also gave her the house and land occupied by John and James Car to pass to his son John at her death or to son Henry if John dies without issue or to son Richard if Henry die sine prole or to daughter Joanne if Richard die s.p. He gave his son Richard 12 acres called "Wards Land" purchased from Clement Williams. He gave his son Henry land purchased from John Parker called "Lewges" and Henry is to pay Susannah 26/8 per year to help bring up the child she is expecting. Henry was also to pay the child £10 when he/she reaches age 21. To his son Harry (the same as Henry?) he gave his house and land in Epping copyhold from John Foster. Harry also received £5 when he reaches age 21. Richard was to receive £13/6/8 at age 21. He gave his daughter Joanne £20 to be paid at her marriage or at age 21. She also received his new cupboard in the parlour, the "joined bedstead and a featherbed, a boulster and a coverlet a pair of blankets and a pair of sheets and 2 pillows... a chest next unto the best... the long settle beneath which hath 2 sheets in it." Harry received "2 mattresses a boulster a coverlet a blanket a pair of sheets a bedstead a platter a pewter dish a saucer a porringer and all my shop gear." Richard got "a feather bed a boulster a coverlet a pair of blankets a pair of sheets a platter a pewter dish a saucer a porringer". He gave his son John the profitts from "Wards Land" until Richard reached age 21 and to bring up Richard and see that he can read and write and to put him in an occupation. He also gave John the lease of his house and land for the remainder of his lease. He gave Susanna "5 kine... my salting trough... my best feather bed a boulster a coverlet a pair of blankets a pair of sheets and 2 pillows...£20". He also gave the child his wife was carrying £10. He also gave Susanna 2 acres of wheat, all his wife's clothing, 2 quarters of wheat and wood to burn. He also willed that Susanna could have the use of his house and land until Car's lease runs out and to pay the rent to his son John. He gave every godchild 6d and the poor people of Theydon Garnon 6/8. He also gave his wife 2 quarters of oats and all the poultry. He gave his godson Harry Browne a good ewe. He gave his son Harry all his clothing. His son John was made the executor and Mr. Francis Michael overseer and Steven Archer, Symond Archer and Francis Archer witnesses.

    John was a yeoman in Theydon Garnon and owned "Wards Lands" and bought "Lowges" from his brother Henry.

    In his will 28 March 1579 John gave the poor of Theydon Garnon 5/. He gave his son John his house and land occupied by Gerrad Dowsett. He gave his wife Anne "Lowges" which he purchased from his brother Henry to pass to his son Richard at her decease or to pass to his son Christopher if Richard died sine prole. He gave his son John £5, all his shop gear and his old brown horse and to confirm "Wards Land" to Christopher. He gave his daughters Anne, Susan and Hester £10 each. He directed his cousin William Stace to oversee "Wards Land" until Christopher reaches age 21. Anne was made the executrix, William Stace overseer and Richard Copland, William Gore and Silvester Ashbye witnesses.(2)

    "Made to James Altham, justice, by Edward Collen and William Fullers, surveyors of the highways in the parish of Theydon Garnon, for the last year, as also touching them that made default [with their] works in this their year, and certifying at they did... the church openly three several sundays for... in the highways of the said Parish for this year.... Labourers Days... Widow Legat 6... Defaulters [this year]... Labourers Days... Widow Legat 4..." 24 June 1581.(1)

    Richard gave legacies of about £200 giving his son Richard 20 rents "the which I have & now go in Cowleas". He mentions his daughter Darnes/Dorcas. He gave £10 "current money unto Mary my daughter wife to John Fodge". His wife Joan was made executrix, William Wood, Francis Archer and Thomas Stacie witnesses.(1)
