'PURSUANT to an Order of the Chancery Division Of the High Court of Justice, made in the Matter of CUSACK-SMITH AND TAPP'S contract, and in the Matter of the Vendor and Purchaser Act, 1874, between Jennie Lady Cusack-Smith, plaintiff, and Robert James Tapp, defendant (1911, C. No. 1742), and dated 29th July, 1911, the following enquiries were directed, namely :
1. Whether Alexander Jones, the testator (named in the above-mentioned contract), had any other child or children other than and besides his sons John
Alexander Jones, Alfred Alexander Jones, and Falkland Jones, and his daughter Ann Braham, and if so whether such other child or any and which of such
other children is or are living or dead, and, if dead, when they died; and whether there is any and what issue living of such other child or children.
2. Whether any and what issue of the said testator's son John Alexander Jones is now living.
3. Whether any and what issue of the said testator's son Alfred Alexander Jones is now living.
4. Whether any and what issue of the said testator's son Falkland Jones is now living.
5. Whether any and what issue of the said testator's daughter Ann Braham, formerly Ann Benjamin, is now living.
6. Whether the said testator's sister, Jane Jones, in the said contract named, had any and what issue; and whether any and which of such issue are now living.
Notice is hereby given, that any persons claiming to be interested under the said enquiries are, personally or by their Solicitor, on or before the 19th day of October, 1911, to come in and prove their claims at the Chambers of Mr. Justice Joyce and Mr. Justice Eve, Room 267, High Court of Justice, Strand, London. Tuesday, the 31st day of October, 1911, at 12 noon, at the said Chambers, is appointed for hearing and adjudicating upon the said claims.-Dated this 11th day of August, 1911.
RICH. JOHN VILLIERS, Vacation Master.
NOTE.-The testator, Alexander Jones, late of No. 4, Prince of Wales-terrace, Kensington, Middlesex, Esquire, died on the 13th February, 1881, partially intestate as to his real estate. The testator's heir-at-law has been found to be his grandson John Alexander Jones (son of the testator's son also named John Alexander Jones). Lady Cusack-Smith claims that she is a grand-daughter of the testator's only sister and that if the said John Alexander Jones, the grandson, were to die in her lifetime, she (Lady Cusack-Smith) would be sole heiress-at-law of the testator, Alexander Jones. The object of the enquiries is to ascertain if this claim is well founded and if Lady Cusack-Smith can make a good title to the interest which, by the contract above-mentioned, she has agreed to sell, and if Lady Cusack-Smith has not a good title then who has a better one. The testator had the three sons and one daughter who are named in the enquiries, and it is alleged that they are all dead without any issue except the grandson John Alexander Jones, who has no issue, and that the testator had no brother and only one sister, Jane, and Lady Cusack-Smith is her granddaughter and only descendant. 087.17'

She left a will on 9 August 1912; The following notice appeared in The London Gazette published on the 9 August 1912':

     'JOHN ALEXANDER JONES, Deceased.
PURSUANT to an Order of the Chancery Division of the High Court of Justice made in the Matter of the estate of John Alexander Jones, deceased, Cusack-Smith v. Jones (1912 J. 1289), the following inquiries were directed, namely :-
     1. Who, by devolution or otherwise, on the death of the above named intestate, John Alexander Jones, became entitled to the real estate to which the intestate was entitled by reason of the intestacy or partial intestacy of Alexander Jones, deceased.
     2. Who were the persons entitled by virtue of or according to the statute of distribution to the intestate's personal estate living at the time of his death,      and whether any of them are since dead, and, if so, who are their respective legal personal representatives. Notice is hereby given, that any persons claiming to be interested under the said inquiries are, personally or by their Solicitor, on or before the 10th day of October, 1912, to come in and prove their claims at the Chambers of Mr. Justice Warrington and Mr. Justice Parker (Room No. 315), Royal Courts of Justice, Strand, London, or in default thereof they will be peremptorily excluded from the benefit of the said order. Thursday, the 17th day of October, 1912, at 12 o'clock, at the said Chambers, is appointed for hearing and adjudicating upon the said claims.- Dated this 31st day of July, 1912.
     CHAS. HULBEBT, Master.
NOTE.-Alexander Jones, mentioned in Inquiry No. 1 (otherwise known as Phineas Zelig), is stated to have been a son of Joshua Falk or Falkland Jones, who was married on 8th October, 1801, at the Great Synagogue, Dukes-place, London, his name as bride-groom being given in the marriage register in English as Joshua Jonas (sic.), and in Hebrew as Falk, the son of Jacob, and the name of the bride being given in the register in English as Sophy Solomons, and in Hebrew as Zipporah, daughter of Joseph. It will probably be found that the persons interested under Inquiry 1 will be traced from the marriage above mentioned.
In regard to Inquiry No. 2, besides kin (if any) on the paternal side, the persons interested as kin would probably be traced through the intestate's mother, whose maiden name was Eliza Ann Barron Jones, she being a daughter of Lewis Barron Jones.
