___ ____ ____ made this 15th day of September, in the year of our Lord 1826 between Charles Lafland, a commissioner, appointed by a decree of the Caldwell Circuit Court of the one part, and SAMUEL KILGORE, of the other part, Witnesseth: whereas at the June term in the year 1826. Of the Caldwell circuit Court a Decree was pronounced therein, in a suit in chancery pending between the said SAMUEL KILGORE complainant, and JONATHAN KILGORE Jr, ISAAC CARTER, and his wife RUTH, late RUTH KILGORE, (& HUGH KILGORE children and heirs at law of WILLIAM KILGORE decd.) JAMES KILGORE, JOHN KILGORE, BENJAMIN KILGORE, DAVID KILGORE, HUGH KILGORE, JONATHAN KILGORE Sr., PUNNCAL (??) WOOD and his wife ELIZABETH, late ELIZABETH KILGORE, ROBERT GREER, and his wife, ISABELL, late ISABELL KILGORE, JANE KILGORE, SAMUEL FOWLER, & his wife, POLLY, late POLLY KILGORE, Defendants: Which decree is in the words following, to wit: This cause came on to be heard, and it appearing to the satisfaction of the Court, that the defendants have been duly warned with process of subpoena, and proclaimation, and they and each of them having failed to enter their appearance herein agreeably to law, and the rules of this Court. It is therefore decreed and ordered that the said defendants & each of them convey unto the said SAMUEL KILGORE, the complainant, with deed of Special Warranty title the said tract of land in the bill mentioned agreeably to the courses and distances contained in said bill on or before the 20th day of July next, and in default thereas, that Charles Lafland is hereby appointed Commissioner to carry this decree into effect. By conveying unto said complainant the said tract of land aforesaid with special warranty title as aforesaid, and report to the next Circuit Court. The said defendants having failed to convey the said tract of land according to the requistions of the aforesaid decree, Now, the said Charles Lafland, Commissioner as aforesaid, for and in consideration of the premises aforesaid, and by virtue of the power and authority vested in him by said decree, and in consideration of the same, (The last paragraph on this first page is illegible except for a few words, RK).

Christian Co.) containing two hundred acres ___ Dryfork and Eddys creek and bounded as follows the ___ Beginning on a Whiteoak and a Gum, thence N80 ____ poles to a Cherry tree Black Walnut, and Red Oak, thence E259 poles to a Black Oak, Dogwood and Whiteoak , crossing the creek at 67 poles, thence S.80. W 124 poles to a hickory, and Black Gum , thence N.10W259 poles to the beginning, crossing the creek at 228 poles patented to WILLIAM KILGORE on this 15th day of May 1821. With its appurtenances, To have and to hold the said tract or parcel of land unto the said SAMUEL KILGORE and his heirs and assign forever; he the said commissioner, convey for said defendants their title in and to said described land, warrants and defends said title from the claim of said defendants and their heirs, and the claim or claims of all persons claiming by, through, or under them, or either of them, in as full and complete a manner , as by law and the powers given him in said decree, he can __ - In testimony whereof the said commissioner hereunto sets his hand and seal the date first written. Caldwell circuit, Set:
I John H. Phelps, clerk, of the circuit court of Caldwell aforesaid do hereby certify that the within Deed of conveyance from Charles Lafland Commissioner to SAMUEL KILGORE , was on this day produced in open court and acknowledged by the said Lafland Commissioner as aforesaid to be his act and Deed for the purposes therein contained, and the same was ordered to be recorded, which was done accordingly. In testimony whereof I here unto set my hand this 23rd day of September 1826. Signed: John H. Phelps

Caldwell County, Set:
I, John H. Phelps, clerk of the County Court of Caldwell aforesaid, do hereby certify that the within Deed of conveyance from Charles Lafland Commissioner to SAMUEL KILGORE, was this day day produced to me in my office, and requested to be recorded and the same together with the certificate of the Clerk of the Caldwell Circuit Court thereon, and this certificate are truly recorded in my office --- In testimony whereof I hereunto set my hand this 23rd day of September 1826.
