LAST WILL AND TESTAMENT OF JAMES MARCUS BROOKS

I, James Marcus Brooks, of Springfield, Clay County, Kansas, being of sound mind and memory and understanding, do make my last will and testament in manner and form following:

First, after the payment of my just debts and funeral expenses, I give, devise and bequeath to my only daughter and child, Eugenia Beatrice Brooks, if living at the time of my death, the sum of two thousand dollars.

Second, I give, devise and bequeath to balance of my property and estate, to be divided equally among the children of my sister, Rhoda Grace Bradbury, the names of said children being William Sherman Bradbury, Marcus Bradbury, Elizabeth Bradbury and John Thomas Bradbury.

Third, I hereby appoint my sister, Rhoda Grace Bradbury, guardian of the person and estate of my daughter, Eugenia Beatrice Brooks, until she becomes of legal age.

Fourth, I hereby appoint and nominate as executrix of this my last will and testament, my sister, Rhoda Grace Bradbury. My desire and wish is that my said sister shall not be required to give any bonds or security to the judge of the probate for the faithful execution of the duties of my executrix.

In witness whereof I have hereunto set my hand and seal the 14th day of September, 1888.
