LAST WILL AND TESTAMENT OF AUGUST SAUVAIN

I, August Sauvain of the County of Clay and State of Kansas, being of sound mind and disposing memory but mindful of death, do make and publish this, my last will and testament, in the words and figures following, hereby revoking any and all former wills and codicils by me made.

Item 1st: It is my will that after my death all of the expenses necessary to my decent interment by Christian burial be paid out of my estate of which I may die seized or possessed.

Item 2nd: That out of my said estate after the payment of the expenses aforesaid, all my just debts be paid as soon as the money can be realized therefrom for that purpose.

Item 3rd: In consideration of my natural affection for my two sons John Sauvain and Jules Sauvain, who reside with me, and who have largely assisted me by their labor and care in the accumulation of the property I now possess, I do devise and bequeath to them as tenants in common, my homestead upon which I now reside in said County of Clay, in said State of Kansas, that is to say, the NW 1/4 of Sec. 34 in Twp. 6 South of Range No. 1 East of the 6th Principle Meridian to each the one undivided half thereof, and also all of my personal property, half to each.

Item 4th: In consideration of the fact that my other children, David Samuel Sauvain of said Clay County, Lewis August Sauvain of the State of Ohio and Eve Virginia Sauvain are in comfortable circumstances and have done nothing toward the accumulation of my said estate, I do hereby give and bequeath to each the sum of one dollar to be paid out of my estate to them by my executors hereinafter named as soon as the money can be realized by them for that purpose out of my said estate.

Item Lastly: I do hereby constitute and appoint my said sons, John Sauvain and Jule Sauvain, the executors of this, my last will and testament, and desire that they be allowed to proceed with the execution thereof without being required to execute any bond as such executors. And it is further my desire that in case of my decease before my said executors shall arrive at the age of majority that my friend Eucher Paradis of the County of Cloud, State of Kansas, be appointed as the administrator of my estate with my said will annexed to act until they both shall have attained majority but no longer.

In witness whereof I have on this 6th day of March, AD 1877, set my hand and seal.
