This is to give Notis to all Persons etc that I Jacob Holtzclaw made over & Promise to Give my Daughter Eve Holtzclaw, Ten Pounts Currt Money & a Negro Girl named Cate, for her Service She Did for her Mother on her Death bed & to her Death, which I say She is to have besides her Share She is to have in the Remainder of my Estate, which Ten Pounds & Negro Girl is to be Delivered to my sd Daughter after my Death. Witness my hand this Twentysecond Day of Augst in the Year of our Lord 1757

The case was brought in an effort to get the estate settled and for payment of the above to Eve, who was married to Allen Wiley.

Peter Hitt gave deposition on 27 Sep 1764. He was about aged eighty and said that he heard Jacob Holtzclaw say that he would give to his Daughter Eve, one Negro Girl named Cate. At the time Jacob appeared to be very much in Liquor and he believes that he did not know any thing he said or did. Peter heard no mention of Money. He signed with his mark.

Joseph Taylor, aged about 40 years also gave deposition on that state. He heard Jacob Holtzclaw say he would give his daughter Eve, one Negro girl named Cate but did not hear him agree to give her any money, saying the Negro Girl was enough. He believes the said Jacob was so much in Liquor at the same time, that he did not know what he said or did.

William Keirns, age about 50 was also deposed. He said he heard Jacob Holtzclaw say that the Parson had been there and wanted him to give his daughter Eve Holtzclaw Ten Pounds and that the Parson drew some instrument of writing and Put in the Ten Pounds along with a Negro Girl. This Deponent said that he said to Jacob that he thought his daughter Eve ought to have something, and the sd Jacob said he thought so to [meaning the ten pounts] as a Reward for her taking care of her Mother when Sick.

Eva HOLZKLAU and Allen WILEY were married about 1758.⁴⁷ Allen WILEY⁴⁷ was born about 1735.⁴⁷ He died in 1812 at the age of 77 in Culpeper County, Virginia.⁴⁷

Mr. Wiley served in the French & Indian War. He was a Baptist minister, serving churches in Orange, Stafford, Frederick & Culpeper Cos.
