7. Capt. John HIGGINBOTHAM26 was born in 1726.5 He served in the military in 1776 at Amherst Co VA Militia in Revolutionary War. He died on 14 July 1814 at the age of 88 in Amherst County, Virginia.26

To wife Rachel the whole of his estate and after her death to son John. Also to John, $1000, being an extra sum for services rendered by him, provided so much remains after comfortable support to wife Rachel and daughter Frances R. Higginbotham as long as she remains single or continues with her mother. Also to Frances, the girls Minerva and Charlotte. Confirms gift of slave Betty to daughter Nancy Higginbotham. Confirms gifts to son James, his full proportion. Confirms gifts to daughter Tirzah London. After death of his wife, estate to be sold and divided into eight parts: son Thomas, son David, son John, son Jesse, son Daniel, son Reuben, dau Frances. (This deed is for half the property conveyed to John Higginbotham by Moses Higginbotham on May 11, 1751. This original whole property contains the residence known as Poplar Grove, built by John Higginbotham in 1773, as well as the London Cemetery and Thomas Higginbotham Cemetery. This property was sold upon John's death, half to Richard Harrison, who immediately sold it to Thomas Higginbotham, and half to John London, husband of Tirzah Higginbotham.)
This indenture made and executed the sixteenth day of December in the year of our Lord eighteen hundred and fourteen between John Higginbotham and Thomas Higginbotham acting as Executors of the last will and testament of John Higginbotham the elder late of Amherst County deceased, the former residing in Nelson County, the latter in Campbell County of the one part and Richard Harrison of the County of Amherst of the second. Witnesseth that whereas the said John Higginbotham the elder by his Last Will and Testament bearing date on the 22nd day of June in the year of our Lord 1813 and now of record in the County Court of Amherst and to which and to which for greater certainty reference is here had, did among other things devise and appoint that the lands of which he died seized and possessed should be sold by his Executors and the money arising therefrom distributed by them to the several persons named in h is said Will; and by same Will did constitute and appoint the aforesaid John Higginbotham and Thomas Higginbotham Executors thereof, who have heretofore duly qualified in the aforesaid County Court and whereas the aforesaid John Higginbotham and Thomas Higginbotham in pursuance of the trust reposed in them by their said Testator, having duly advertised the time and place of sale for one month in the Sentinel and Press two public newspapers edited in the Town of Lynchburg, did on the twenty ninth day of November now last past expose to public sale the following tract and parcel of land lying on the branches of Rutledges Creek and hereafter more particularly described, at which sale the aforesaid Richard Harrison being the highest bidder became the purchaser of the said tract and parcel of land for the sum of four thousand and sixty one dollars by the said Richard Harrison to us in hand paid before the unsealing and delivery of this indenture, the receipt whereof is hereby acknowledged, we the aforesaid John Higginbotham and Thomas Higginbotham as aforesaid, have granted, bargained and sold and by these presents do grant, bargain and sell to the aforesaid Richard Harrison the following tract and parcel of land lying on the branches of Rutledges Creek in the said County of Amherst and bounded as follows, to-wit: Beginning at pointers on William Morrison's corner; thence N. 6° W. 400 po. To poplar pointers and stone, N. 85° E. 85 pos. to four red oak pointers 56° E. 394 po. To pointers of red oaks and 385° W.E. ____ W 85 poles to the first station, being one of the several tracts and parcels of land of which the said John Higginbotham died seized and possessed, to have and to hold the said tract and parcel of land containing by estimation the quantity of two hundred acres of land be the same however more or less to him the said Richard Harrison and to his heirs in fee, and the said John Higginbotham and Thomas Higginbotham acting Executors as aforesaid do for themselves and all persons claiming under or thru them or either of them warrant and defend to the said Richard Harrison his heirs forever all such rights and title in and to said described tract or parcel of land as the said John Higginbotham the elder possessed and was seized of on the day of his death, and all such rights and title in the same as is vested in them as Executors by the aforesaid will of their Testator. In Testimony whereof we have this day and year aforesaid, as Executors as aforesaid hereunto set our hands and affixed our seals in the presence of witnesses.

Rachel was the daughter of Gerrard and Anne (Staunton) Banks of Amherst.

Thomas HIGGINBOTHAM was born on 10 June 1769 in Amherst County, Virginia.23,26 He died on 4 February 1835 at the age of 65 in Amherst County, Virginia.26

To sister Tirza London, the tract of 200 acres where I now live and 40 acres adjoining, bought of George McDaniel, with all household and kitchen furiture and at her death to go to her younger children, Mary Banks, and William Augustus. To John J. London, tract I bought of William Rourne. To Daniel H. London, the tract I bought of Charles B. Taliaferro. To France Woodroof and her children, the tract called Camdens D. & B. Higginbotham & Co. To sister Ann Staunton Higginbotham, late of George, her children 20 shares of Farmer's Bank Stock. To children of brother James Higginbotham, late of Georgia, his children 20 shares of Farmer's Bank Stock. To brother Daniel Higginbotham, 50 shares Virginia Bank Stock. To sister Frances R. Coleman, whatever debt she owes me at the time of my death. To Wesley Jones son wife Archey Carey, $1,000. To brother Daniel in trust for the following persons: 15 shares in Bank of U.S. for Jessee Higginbotham; 15 sh...for Eugene Higginbotham, my brother; 20 sh of Farmer's Bank stock for benefit of Meeka Higginbotham, wife of James S.; 10 sh Virginia Bank stock for Nancy, my cook woman; 10 sh of Farmer's Bank stock for Maria, my house woman; 5 sh Farmer's bank stock for Tom Casey, Maria's son; 5 sh ...for John Waller, Maria's son. I give to Nancy & Maria a bed & furniture and cow & calf each.
All my negroes are to be set free, viz: Nancy, my cook woman. Maria and her sons, Tom Casey & John Wallen. Caleb and their increase. Washington, Charles, Dandridge, William, Daniel, Spencer, Polly, Isaac, Carter, Ann & her children & their increase, Charlotte and her children & increase, Jean and her children & increase; China & her children & increase, provided they are willing to leave the State. If not, they may choose any of my brothers and sisters they are willing to serve. It is my wish that my brother Daniel, in case Nancy & Maria should not be willing to leave the State, he will become Guardian for them and the bank stock will be sufficient to maintain them.
The balance of my estate to be divided. 1/8 to the children of my late brother James. 1/8 to the children of my sister, Anne Higginbotham. 1/8 to David Higginbotham. 1/8 to Daniel Higginbotham. 1/16 to William S. Higginbotham. 1/16 in trust for my brother Reuben Higginbotham's two son. 1/16 to Daniel in trust for Jesse. 1/16 to Daniel Higginbotham in trust for Eugene. 1/8 to my sister Frances R. Coleman. 1/8 to my sister Tirzah London.
Executor: brother Daniel Higginbotham. He is expected to sell whenever he think best any property not mentioned above. No witnesses. Amherst WB 9, p.47.

Thomas Higginbotham owned a slave named Archer Cary Higginbotham (named in the will above). Archer was acquired in 1801 and freed in 1822 for faithful service. Thomas is said to have organized two petitions (1822 and 1833) to the Virginia legislature on Archer's behalf so he could remain in Virginia as a freeman. Both petitions were denied. Archer died in Virginia in 1842, leaving a wife and five children; a thriving hack-driving business. He owned 400 acres between Amherst & Campbell Counties. His son William Burton Higginbotham left for Georgia in 1840 and owned a tavern in Romer, GA. He died in 1881 - his obituary stating he died "the richest Negro in the state".

Jessie HIGGINBOTHAM was born on 23 December 1779 in Amherst County, Virginia.23,26 He died on 8 June 1836 at the age of 56 in Nelson County, Virginia.26

Eugene may have been impaired in some way. Both his father's will and the will of his brother Thomas, leave bequests to Eugene in trust for one of his other brothers, although he was certainly of majority age.
