98. Benjamin FRYE III2 was born on 25 December 1758 in Frederick County, Virginia.42 He died on 24 July 1838 at the age of 79 in Iroquois County, Illinois.2

Nancy Cadwalder was the 2nd wife of Benjamin Frye. His first wife was Ruth Courtwright. Benjamin resided in Redstone PA during the Revolution.

Nancy applied for Benjamin's pension some years after his death. R3818. She gave rather fanciful reports of his service and appeared to list the unit of her father-in-law Benjamin Fry. Her claim was rejected, saying there was no record. The Benjamin Fry alleged to have served was of Nelson Co and had died soon after and had no children.

29 Apr 1793. Benjamin Frye and Catherine sold to Benjamin Fry Junr, two tracts - one of 118 acres, the other 25 3/4 acres - for 200#'s. Description of the smaller tract mentions waters of Cedar Creek, the Little North Mountain; the north edge of the great road to Winchester; line of Benjamin Fry's 214-acre tract. This smaller 25 3/4 acres was part of 300 acres original sold to Paul Froman by John Branson, 28 Jun 1739. The 118-acre tract was part of a larger tract of 214 acres granted Paul Froman, deceased, 3 Apr 1753; south east of Little North Mountain; adjoining the smaller tract; Isaac Zane's land and John Carmell's property. Wit: Joseph Longacre, Joseph Fawcett, Arariah Edward. Frederick Co DB 23, 695-699; recorded 7 May 1793.

Frederick Co VA. On 3 Apr 1797, Benjamin & Catherine Fry sold to Isaac Frye three tracts totalling 233 acres for 300#'s. The first tract, 56 acres was part of 300 acres conveyed by John Branson to Paul Froman and by him to Abraham Ferree [Farrell] and by Ferree to the said Benjamin Frye. The second tract was 159 acres, part of 353 acres granted to Paul Froman, sold to Abraham Ferree and then to Benjamin Frye. The third tract was 18 acres adjoining the others, part of 444 acres granted 3 Jan 1775 to Benjamin Frye. All parties were of Frederick Co. Benjamin signed with his mark; Catherine apparently signed her own name. Wit: Joseph Longacre, Nathaniel Cartmell, and Joseph Fawcett. Frederick Co DB 25, p.59-61.
Isaac Frye and Catherine his wife, sold the same three tracts to Benjamin Fry, tanner, in October of 1800. [Isaac's brother Benjamin Fry] Wit: Joseph Longacre, P. Williams, Joseph Frye, John Arch Deacon, Jas. Singleton. Catherine could not travel to court but her consent was obtained 16 Oct 1800. Williams & Singleton proved the deed 5 Apr 1802. On 5 Jun 1826, Longacre long being dead, his signature was proved by oath of Philip P. Boucher and the deed was finally recorded. Frederick Co DB 51, p.378-381.

19 Apr 1803. Benjamin Frye and Nancy his wife sold to Samuel G. Sydnor, five tracts of land totaling 376 3/4 acres in Frederick Co for $6,000. The tracts were the two sold to him by his father, and three tracts from his brother Isaac. The seller is identified as Benjamin Frye, Tanner. Nancy signed as Ann Frye. Wit: Jas Singleton, Edward McGuire Junr, Robt Leewright. Not until 5 Aug 1811 did all the witnesses sign and the deed get recorded. Frederick Co DB 33, p.161-163.

20 Apr 1803. Mortgage Deed. Samuel G. Sydnor to Benjamin Fry for 200#'s. According to notes from Don Kearney, the mortgage holder was not the same Benjamin Frye. If that is so, it was likely Benjamin's father.

Benjamin FRYE III and Ruth COURTWRIGHT were married in 1782. Ruth COURTWRIGHT89 was born in 1765. She died in 1795 at the age of 30 in Frederick County, Virginia.

The application of Ann (Cadwalder) Fry for Benjamin's pension from the Revolution stated that Isaac and Abraham were twins.

Benjamin FRYE III and Ann "Nancy" CADWALDAR were married on 18 May 1802 in Frederick County, Virginia.42 Ann "Nancy" CADWALDAR was born on 25 February 1784 in Pennsylvania. She died on 15 May 1861 at the age of 77 in Iroquois County, Illinois.

Ann made application from Iroguois Co, IL, 2nd Nov 1852 for her widow's pension. She testified from her residence due to bodily infirmity. she was aged 69 years. She believed her husband, Benjamin Fry (deceased) was a Private in the Revolution, enrolled in Virginia and served three years and eight months. He served under General Washing & General Warren & General Gates & helped take Burgoynes force and was at the Battle of Bunkerhill. [A note between the lines states that the above may be a mistake.] She didn't know where he was discharged or what became of it.
They were married 18th day of May 1802, Frederick Co, VA - there is no record she knows of. She and her husband were natives of Frederick County. She was Ann Cadwaleder before her marriage. Her husband died in Iroguois Co on 24 Jul 1838, at which time he was 79 years and 6 months of age.
There are five children surviving. Isaac & Abrahm, aged 64, twins. John Fry aged 45. Benjamin Fry aged 49. Joseph Fry aged 42 - the said Isaac & Abraham were children by his first wife and no record evidence exists of their births or age. Signed: Ann Fry

In this file are papers relating to a VERY DIFFERENT Fry family. Even the date of 1834 shows that they are not part of the above Ann's petition.It is a petition of the heirs of George, Benjamin, Gabriel & John Fry, brothers who had all enlisted in 1777 in the service of Virginia. The first three served out their time. Joseph Fry, another brother enlisted at the same time. George Fry died in service and his heirs received the bounty land promised. North Carolina, Stokes County - June Court (no year stated) - Henry Carter testified that John, George, Benjamin, Joseph and Gabriel, all brothers, did enlist as soldiers and Joseph and George died in the Army, leaving no children or heirs. Since the war all the remainder have died, none of them leaving heirs but John Fry's children.
Gabriel Fry, son of John Fry, dec'd made oath that he believes all his uncles, George, Benjamin, Jsoeph & Gabriel, died without heirs except himself & his brothers and sisters: Benjamin Fry, Quincy Fry, Delilah who intermarried with William Lawson, Nancy married Jonas Lawson, Elijah Fry, Thomas Fry, Zada who intermarried with Wm Collins. He has always understood his father, John Fry was a regular soldier during the Revolution. signed: Gabriel Fry.

The names of George & Gabriel Fry appear on the Army Register. John & Benjamin Fry have not be found there. Joseph Fry died in service and his heirs have received bounty land. There is no proof of the other service or that the others served to the end of the war. On the evidence offered, the claim should not be allowed. Dated 19 Apr 1834
