Re the Guardianship of James Iverson Boswell & Martha Ann Boswell. Petition of James Boswell, guardian of James Iverson and Martha Boswell who are minors under the age of 14 years. Christopher Brooks, grandfather of said minors, departed this life in NC , having previously on the 15th of Sept 1839 made and published his last will and testament. The balance of his estate was loaned to his wife Isabella Brooks for her life or widowhood and at her death to be divided equally between her children, eight in number. Mary Brooks, the wife of your petitioner and mother of said minors was one of these children. Mary Brooks departed this life subsequent to the death of the said Christopher Brooks and prior to the death of Isabella Brooks who departed this life about March of 1851. It is a matter of doubt whether he as the husband is entitled to the part of Mary Brooks, or whether the same belongs to her children - if to them, they should have a legally appointed guardian to protect and secure their interest. He would like letters of guardianship granted to him. He also claims that the residue of the estate would likely be $1000 each. Signed: James Boswell
