ORIGINAL WILL OF HEINRICH BUTZ
IN THE NAME OF GOD, AMEN, I Henry Butz of the township of Oxford, County of Warren and State of New Jersey, being of sound mind and memory and understanding,for which blessing I most devoutly thank my God, do make and publish my Last Will and Testament in manner and form following:
THAT IS TO SAY, FIRST : It is my Will and I do hereby order that all my just debts and funeral expenses be duly paid and satisfied as soon as conveniently can be after my demise.
FIRST; I give and bequeath unto my beloved wife, EVE BUTZ, an equal third part of the grounds or rent of the farm on which I now live during her natural life, together with the front room of the mansion house on the premises, half of the entry kitchen cellar and milk house and as much of the goods as she may think necessary for her own use and also the choice of my stock of cows which is to be kept on the place summer and winter and also as much of the household and kitchen furniture of all kinds as she, together with my Executors, may deem necessary for her own use and to have her firewood hauled to her door and cut sufficiently short for her stove or fireplace, as she may require, and carried into her room if she requires it.
ITEM: I give and bequeath the farm on which I now live after my decease to my youngest son, ELIAS BUTZ, on the following conditions: To have full possessions thereon immediately after my decease , EXCEPT so much as has been heretofore reserved for the benefit of my wife, EVE, THAT IS TO SAY, He is to pay my executors at the rate of twenty dollars per acre for what is contained in the farm above said and eight dollars per acre for thirty acres off of the east end of my wood lot on Scot's Mountain, but I do hereby order and it is my Will that my said Executors allow my son, ELIAS BUTZ, eight hundred dollars out of the purchase money of the farm and wood lot aforesaid, to be deducted from the whole, which I intend for his first portion out of my estate to make him equal to my older sons and the residue of my purchase money to be paid to my executors in annual payments of two hundred dollars each, the first payment to commence one year after the decease of my wife, provided she should outlive me. BUT if not in one year of my decease, but in case my said son, ELIAS, does not consent, to take the farm and wood lot on the farm, herein set forth or either of the them, then it is my Will that my Executors sell the same as hereinafter directed, reserving the privileges already granted to my wife, EVE , and it is my Will that my Executors in one year after my decease, shall sell all of my real and personal estate except so much and such parts thereof as are hereinbefore disposed of at public sale or therewise as they may think advisable and divide the proceeds equally, share and share alike between my sons and daughters, except my daughter, EVE KLEINHAUS, wife of JACOB KLEINHAUS, which I NOW GIVE AND BEQUEATH ONE DOLLAR to, considering it with what she has already had to be her full share of my estate = the residue as above said to be equally divided between my sons and daugters, hereinafter named, THAT IS: CHRISTIAN BUTZ, PETER BUTZ, MICHAEL BUTZ, PHILIP BUTZ, HENRY BUTZ, ADAM BUTZ, ELIAS BUTZ, ELIZABETH BARTLEMEY, CATHARINE HESS, MARY BERGER, SUSAN HILES, MARGARET BARTOW, SARAH FOSTER, CHRISTINA BUTZ, (sic:wife of Chapman Warner)to be paid to them by my Executors in the following order, TO WIT: WITHIN ONE YEAR AFTER MY DECEASE, TO PAY MY SONS, ELIAS & ADAM,, one equal fourteenth part of the proceeds of the sales of my estate, aforesaid and in one year thereafter to pay the next youngest of my children, CHRISTIAN BUTZ AND SARAH FOSTER, each one l4th. part of the proceeds of the sales of my estate abovesaid, and so on in the same order, paying each of my other above-named sons and daughters with the above named exceptions, their and each of their equal l4th. parts of the proceeds as aforesaid, two each year beginning with the youngest and so forth until the whole is equally divided. It is my wish and I do order my Exeuctor to deduct fifty dollars out of the portion bequeathed to my daughter, MARGARET BARTOW, before any interest iis allowed to her, it being the amount I paid the Easton Banker, her husband. This being my Will, concerning the portion of my estate which may be alloted to my daughter, MARGARET BARTOW, anything contained in the clause wherein all of my children are named. To the contrary, notwithstanding, and in addition to the bequeath to my beloved wife, EVE, I ENJOIN ON MY SON, ELIAS, or whomsoever may live on my homestead, that they shall take her grain to the mill for her and fetch it home to her when ground into flour and that she shall have privilege to raise and keep one hog on the premises. If she thinks it wise from year to year, during her natural life - ITEM; IT IS FURTHER MY WILL AND ORDER, AND I HEREBY DIRECT, my Executor to sell all my real and personal estate except whatsoever is herein disposed of at private sale or otherwise within one year after my decease and divide the proceeds as hereinbefore mentioned and WHEREAS, I have, in my lifetime, given each of my sons herein mentioned, three hundred pounds each and each of my daughters , two hundred pounds in monies, to enable them to commence business for themselves, for which I have taken their respective receipts, except my son, ELIAS, who is to receive three hundred pounds as in my said Will , That those several sums given to my sons and daughters shall not be brought into the estimate of the residue of my estate, but shall be considered as settled and at an end. NOR SHALL they be brought into the amount nor have any bearing or in any way, effect the distribution of my esatate as directed in this Will.
AND LASTLY, i HEREBY NOMINATE AND APPOINT, my son-in-law JEREMY HESS, and my son HENRY BUTZ, Executors of this my LAST WILL AND TESTAMENT.

The Will of Henrich Butz
I, the within named Testator do make and publish this second codicil to this my Last Will and Testament. That WHEREAS, the circumstances of my family affairs having undergone a considerable change since adding my first codicil : ITEM, it is therefore my Will and I do hereby order and direct my Executor in my Last Will and Testament named that in the final settlement of my estate with my sons and daughters therein named to charge and deduct out of my son, PETER BUTZ, share or portion, the amount of $350.00, with the interest accruing therein from the first day of April, eighteen hundred and twenty nine until the time of my decease, it being the amount of two certain Bonds and one sealed bill I now hold against my son, Peter for monies advanced to him and I do further order and direct my executor as aforesaid to charge and deduct out of the share a portion of my estate, which will become due to my son, MICHAEL BUTZ, one hundred and fifty dollars with the interest accruing therein from the 29th. day of June 1837 advanced to him as will appear by his note of hand which I now hold against him. Also, it is my Will and I do hereby further order and direct my Executor as aforesaid to charge and deduct from the share or portion which may become due to my daughter, Sarah Foster, the sum of $93.00, together with the interest accruing therein at my decease, THAT IS TO SAY, calculating the interest on forth dollars from and after the first day of May, 1834 and on $53.00 from and after the 30th. day of November, 1838, it being for money to her at the aforesaid dates and I have charges against her in my book of accounts and then to pay the said Peter, Michael and Sarah, the balance if any, which may found due to them in the final settlement of my est ate after making the aforesaid deduction, AND IT IS ALSO MY WILL, and I do hereby order and direct my Executor as aforesaid due to the children of my daughter, Christine Warner, in good bonded security, one year after my decease and pay the interest accruing therein annually to my said daughter, Christine Warner, during her natural life and at her accord to divide the principle sums so invested equally share and share alike between the children then living. These several items and alterations I DO HEREBY ENJOIN on and direct my said Executor to observe and perform anything in my last Will and Testament or first codicil to the contrary notwithstanding. IN TESTIMONY HEREOF, i HAVE HEREUNTO SET MY HAND AND SEAL THE FIRST DAY OF fEBRUARY IN THE YEAR OF OUR Lord 1842.
