This is the last Will and Testament of Andrew Hartsfield Sr. - dated Nov.
1761

In the Name of God Amen. I Andrew Hartsfield of the County of Johnston and
Province of North Carolina Planter knowing the Mortality of my Body & that it
is appointed for all Men Once to Die Do hereby make and Ordain this my last
will & Testament in manner & form following that is to say Principally I
Bequeath my Soul into the hans of Almighty God who gave it me not Doubting,
but my Ever Blessed ReDeemer will restoreit to me again at the Day of general
Resurrection and my Body to be Buried in a Decent & Christion manner at the
Discretion of my executors to be hereafter named. And as to what wordly
substance it has pleased God to bestow upon me: after paying all my lawfull
Debts of funeral Expences I leave & bequeath it in the Following manner
(there are 2 words here that I cannot read) I leave & bequeath my two
Plantations & the tract of Land pertaining to them to my three Beloved sons
Godgrey, Richard & John to be equally Divided among them only it is my will &
desire that the Plantation where on I now live may be included in the share
of my son Godfrey and that the plantation where on Thomas Smith now lives may
be uncluded in the share of my son John

Item I leave & bequeath to my beloved son Godfrey my Rifled Gun and one Cow &
calf and one Sow and one Mare which I formerly gave him.

Item I leave & bequeath to my said Bloved son Richard my best smooth gun &
one cow & calf & one sow and a mare which I formerly gave him.

Item I leave & bequeath to my said beloved son John my other smoth gun & one
cow & calf & one sow and it is my will & desire that my said son John may
have the first colt that my own mare brings.

Item I leave & Bequeath to my Beloved son Andrew one sow and a more & colt
which I formerly gave him.

Item I leave & bequeath to my Beloved Daughter Rebecca a Horse which I
formerly gave her

Item I leave & bequeath to my beloved wife Sarah Hartsfield, on third part of
my whole emaining & moveable Estate to be by her enjoyed dureing her Natural
life.

Item I leave & Bequeath the other two thirds of my moveable Estate & all my
other Estate both real & personal that I have not already hereby disposed of
to my folling beloved children, Jacob, Mary Rebecca, Andrew, Sarah and Betty
to be equally divided among them.

and I hereby appoint William Meikleroy & my two beloved sons Jacob & Godfrey
Executors of this my last will and Testament Revocking all former wills by me
made and Declaring this to by my only last will & Testament In witness
whereof I have hereinto set my hand & seal this 18th Day of November 761.

Andrew married (1) Sarah LYNN about 1736 in Baltimore Md or Wake Co., NC. Sarah was born about 1700 in of Johnston Co., NC. She died after 1761 in NC.

They had the following children:

  8 M i Jacob HARTSFIELD was born on 3 Jan 1737 in NC. He died after 1768.

This Indenture mad this 31 day of December in the
year of our Lore one thousand seven hundred and Ninty six Between
Jacob Hartsfield of the County of Franklin in the State of North
Carolina of the one part and Andrew Heartsfield of the County of Wake
and State aforesaid of the other part Witnesseth that the said Jacob
Heartsfield for and in consideration of the sum of five pounds currancy
of the aforesaid State but more Espessily <sic> for the love and sosiety? the sd. Jacob Heartsfield hath for his son Andrew Heartsfied
to him in hand paid at or before the ensealing and delivery hereof the
receipt is hereby acknowledged and the said Jacob Heartsfield to he the
said Andrew Heartsfield hath hereby granted bargained sold and delivered
and firmly by these presents doth fully and absolutely grant bargain sell
and confirm unto the said Andrew Heartsfield his heirs and assigns forever
a certain tracts or parcel of land in Franklin County containing Nine Hundred
and Sixty acres be the same more or less including the plantation where I
now live. Beginning at a corner red oak Jacob Heartsfiled old corner red
oak on the south side of Jacob Heartsfield mill creek runing east a cross
the sd. creek fifty two poles to to a pine in Jeremiah Perry's line then
north along the sd. line to his corner former hickory now a pine and red
oak then east along the afresaid Perry's line to grait Crooked Creek to a
willow oak on the creek, then up the sd. creek to a pine on the bank of the
creek at the mouth of a branch that runs close by an old field called Amuses
old field Turn Bulls line then up the sd. branch to a crooked white oak the
north side the sd. branch then north along Turn Bulls line to a post oak
then west along Turn Bulls line to a corner hickory & pine then north along
the sd. line to a corner pine in the wido Mullings line, then west along
her line to a corner white oak & hickory then south along Michels line to
a corner post oak & pine, then west to a corner post oak & two red oaks
along Michels line then south along Michels line to a white oak & pine then
west along the sd. line to John Smiths corner post oak then south along
Smiths line crossing the aforesaid mill creek along James Sanders line to
a former corner red oac it is down now a pine and hickory in Robert Sanders
line then east along the sd. line to the miry branch corner of his fence
then down the said branch to the mouth <illegible> long Branch then down
the long Branch to a poplar in <illegible> Heartsfield old line then east
along the sd. line & Joseph Freemans <illegible> to the first station to
conclude nine hundred and sixty acres <illegible> be the same more or less
together with all appurtanances to the sd. land belonging and appertaining
and all his right title and interest in and to the sd. premises & every
part and parcel thereof with the appurtanances therunto Belonging with all
houses out houses and buldings thereon wood and under woods waters mines
mills and all appertanance thereunto Belonging. To have and to hold the
sd. tract and parcel of land with all profits and privileges to the same
belonging to he the said Andrew Heartsfield his heirs and assigns forever
he or they paying tax for the same and the sd. Jacob Heartsfield his heirs
and assigns Exrs. and admrs. doth covenant and agree that the above granted
premises are free and clear of all charges and incumbrances whatsoever and
he the said Jacob Heartsfield for himself his heirs Exrs. admrs. or aassigns
shall and will warrant secrue and defend the property and sail of the sd.
land and premises to he the said AndrewHeartsfield his heirs exrs. admrs.
or assigns forever against the lawfull claim or demand of any person or
persons whatsoever. In witness whereof the sd. Jacob Heartsfield hath
hereunto set & put his hand and seal the day and year first above written.
