Last Will and Testament of Henry Schies.

In the name of God, Amen.

I, Henry Schies of Anderson in the County of Madison, State of Indiana, being of sound mind and memory and considering the uncertainty of this frail and transitory life, do therefore make, ordain, publish and declare this to be my last Will and Testament.

FIRST, I order and direct that my Executor hereinafter named, pay all my just debts and funeral expenses as soon after my decease as conveniently may be.

SECOND, After the payment of such funeral expenses and debts, I give, devise and bequeath to Emma Arleia Emmert Schies an estate for life in the real estate located at 2215 Fletcher Street, Anderson, Indiana, being lots numbered 81 and the south half of lot numbered 82 in South Park Addition to the said City of Anderson, Ind.

THIRD, And I give devise and bequeath to Loretta Schies the above described real estate in fee-simple, subject to a life estate to Emma Arleia Emmert Schies.

FOURTH, I give devise, and bequeath to Loretta Schies all other property, real or personal, of which I may own at my decease.

LASTLY, I make, constitute and appoint Joseph Lucas Schies to be Executor of this, my last Will and Testament, hereby revoking all former wills by me made.

IN WITNESS WHEREOF, I have hereunto subscribed my name and affixed my seal the 27th day of June, in the year of our Lord, one thousand nine hundred and thirty two.

This instrument was on the day of the date thereof, signed, published and declared by the said testator, Henry Schies, to be his last Will and Testament in the presence of us who at his request have subscribed our names thereto as witnesses in his presence and in the presence of each other.

PROOF OF WILL

IN THE MATTER OF THE ESTATE OF
HENRY SCHIESS
DECEASED
PROBATE OF WILL

An instrument in writing purporting to be the last Will and Testament of Henry Schies, is now produced for probate and record, which said last Will and Testament is in the words and figures following, to wit: (Here insert).

And comes now Sid M. Cleveland one of the subscribing witnesses to the said last Will and Testament of Henry Schies, and testifies to the due execution of the said instrument in writing, and says at the same time that the said testator was of the full age of twenty-one years; of sound mind and memory; that he was not under coercion, compulsion or restraint and that he was competent to devise his property, which said testimony was reduced to writing, and subscribed and sworn to by said subscribing witness, and which said testimony is in the words and figures following, to-wit: (Here insert).

And the Court having heard the evidence and being well advised in the premises, orders that said last Will and Testament of Henry Schies be and the same is hereby admitted to probate and record.

BOND, OATH AND LETTERS TESTAMENTARY

Comes now Joseph L. Schies and shows to the Court that pursuant to the terms of the last Will and Testament of Henry Schies deceased, he was appointed as the Executor of the said last Will and Testament, and he now tenders his bond in the penal sum of One Hundred ($100.00) Dollars, payable to the State of Indiana, and conditioned for the faithful performance of his duties as such Executor without surety thereon; and he now makes and subscribes his oath for the faithful performance of his duties as such Executor, which said Bond and Oath are in the words and figures following, to-wit: (Here insert).

And the court having seen and examined said Bond and being sufficiently advised in the premises as to said Bond, now approves the said Bond in open Court, and orders and directs the Clerk of this Court to issue Letters Testamentary to the said Joseph L. Schies.

And pursuant to the above and foregoing order of the Court the Clerk thereof, now issues Letters of Testamentary to the said Joseph L. Schies, which said letters are in the words and figures following, to-wit: (Here insert).
