Houghton v Thompson (1866) , 25 UCQB 557 ; PG 277: PG 139 .
The case of Houghton V. Thompson was an example . In 1861 a tenant signed a a written rental agreement with Henry Becher of Metcalfe Township for one year from 1862 until 1864 the tenant remained on the property , paying an annual rent , but no new agreement with a fixed term was put into writing . A misunderstanding emereged : the Tenant believed he still had a one year lease formally renewed . Becher refused because he was selling the property . The tenant refused to leave unless Becher paid for improvements. Becher demaned possession . The tenant claimed he still was entitled to si months notice to quit. Becher claimed he had no such right since he held year to year and with noo fixed term . At the local assizes in London the following Spring, the judge sided with Becher and the jury sided with the tenant. When the case went to the high court for consideration, the judge ruled that no notice to quit was required .
DeathDec 23, 1868Northumberland, Ontario, Canada, Davis: I assume died in either Haldimand or Cramahe Township, Northumberland County, Canada unable to find him in any of the online census returns for Haldimand or Cramahe twp or Michigan1,5
