Deposition of Roger Ternen aged about 30 years: About Jan 1669/70 Ternen was at his own house, where Peter Walker and John GONSALVO made a bargain of work. They agreed that Walker would furnish Gonsalvo with tools to work at their trade. Walker would have two thirds of the payment for their labor and Gonsalvo one third. When Gonsalvo could furnish his own tools, he was at liberty to work for himself. Signed 20 Jul 1671 by Roger (X) Fornen. (sic)

This indenture made the eleventh day of February one thousand six hundred and seventy and five now know ye that I Joseph Newton of the Co., of Accomack Cooper with the consent of my wife Ann do hereby wit and set unto John GUNSOLIUS Spaniard a certain parcel of land containing one hundred acres lying and being on Onancock Creek on the north side of Spoon Branch at the head thereof and is part of a ___ of land containing three hundred and fifty acres of land formally granted to George Truit. sold as by Patent from the Honorable Goorin will approve which land was purchased by the said Newton from Henry the __ son of a friend of George Truit and will approve upon the record in the Co., office of Accomack.

To all to whom these present shall come to know that I Adam Keeling of the Co. of Princess Anne for diverse good causes and considerations me hereunto moving but more especially for in consideration of the sum of five thousand pounds of porke, for with have received good caution for payment from William CONSALVO of the same Co. have bargained sold confirmed and by these present do bargain alienate sell confirm unto the said William CONSALVO a parcel or tract of land by estimation to be fifty acres be it more or less situate lying and being in the aforesaid Co. bounded as followeth Beginning at a marked red oak standing by the dams and so running alongst a deep branch to a marked white oak so by a line of marked trees and so along the dams to the first station to have and to hold the said William CONSALVO his heirs or assigns forever with all immunities and privileges whatsoever or as free and ample manner as I the said Adam Keeling hold the grand patent which I purchased of Alexander Keeling and he of Colonel Ant. Lawson the aforementioned bargained premises being part of the said patent and the said land together with the appetences to hold use occupy hosses and enjoy clearly and freely and absolutely from the said Adam Keeling my heirs and that the said land is at the date of these present clear from all other bargains, sales, gifts, grants, right of dower or any incumbances whatsoever hereby warranting the sale of the land unto the said William CONSALVO and his heirs forever from me the said Adam Keeling, my heirs as also do oblige myself my heirs to acknowledge this sale in open court as also my wife Susanna shall acknowledge the same as to her part when thereunto required as witness our hands and seals this 17th day of October, 1695.

Grace Davis presented to the court her granddaughter named Rachall CONSSALVIS (7 years old last December), the orphan of William CONSSALVIS. With the grandmother’s consent, George Cutler agreed to take the child as an apprentice. Ordered that the church warden bind Rachall till she arrived at legal age; Cutler was to teach her to read, knit, sew, and spin linen and wooling. At the end of her indenture, he was to her according to law. (Pg. 22)

This indenture made the twenty fifth day of March in the year of our Lord one thousand seven hundred and thirty on this fourth year of the reign of our Sovereign Lord George the second, King of Britain between Richard GARDNER and Elisabeth his wife of the parish of Lynnhaven County of Princess Anne of the one part and John CONSOLVO of the same parish and county of the other part witnesseth that the said Richard GARDNER and Elisabeth his wife for in consideration of five shillings hereby acknowledge have bargained and sold and by those present do bargain and sell onto the said John CONSOLVO one hundred acres of Land more or less lying and being at the fork of a branch which parts ye about said land from the land whereon the said John CONSOLVO now lives and running up the said branch by it’s natural boundary to a line of Marsh across running water to a corner gum then by a line of Marsh and reversions and remainders and remainders together with the rents and profits of the parcel of land with appurtances and all and singular the promises therein unto the said John CONSOLVO his exor’s and assigns from and before this date and during this term of one whole year from ____ next issuing fully to be completed and so yielding and paying therefore yearly rent of one ___ per corn at the feast of St. Michael the archangel only if his sums be demanded to the ___ by virtue of those present and of the statue for transferring into the possession thereof and of all other premises bearable to accept of a grant of the reversion and inheritances thereof to him and his heirs in witness whereof the said Richard GARDNER and Elisabeth his wife have here unto set there hands and seals the day and year first above written.

Witnessed that ye said Richard GARNER and Elizabeth his wife for in consideration of ye sum of five shillings currents money of Virginia to them in hand paid by the aforesaid William CONSAUL ye receipt thereof they do hereby acknowledge have bargained and sold by these present do bargain and sell unto the said William CONSAUL one certain parcel of land containing by estimation fifty acres more or less situated lying and being in ye said county of Princess Ann in ye Eastern Shore Swamp bounded as followeth vitz beginning at a maple standing at ye head of ye eastern fun in Col. Maximillion BOUSHES line thence running south west by a line of marked trees to a birch in the said William CONSAUL line thence easterly by a line of marked trees to a gum standing in the said eastern run thence bounding on the said BOUSHES line running up the said eastern run to the first station and ye reversioned remainder and remainders together with the rents and profits of ye premises herein mentioned or intended to be hereby sold with their and every of their appurtances unto ye said William CONSAUL, his exors, and assigns from ye day before ye date hereof for and during the term of one whole year from thence next ensuing and fully to be completed and ended yielding paying therefore yearly rent of one piper of corn at ye Feast of St Michael the Archangel only if ye same be lawfully demanded to ye intent that by virtue of these present and of the state for transferring uses into possession the said William CONSAUL may be in ye actual possession of the premises to be enables to take and accept of a grant of ye reversion and inheritance thereof to him and his heirs forever. KNOW ALL MEN by these presents that I William CONSAUL of Princess Anne County in the Colony of Virginia for diverse good causes and considerations me thereunto moving, but more especially for and in consideration of the Paternell love and respect which I have and bear unto my son William CONSAUL for his future support and maintainances, I do hereby give unto him my said son, William CONSAUL the plantation whereon I now live containing one hundred and fifty acres of land, more or less with all houses, gardens, orchards and other appurtenances thereunto blonging or in any wayes appurtaining to him my said son, his heirs and assigns forever only reserving the whole use and benefit of the same to my self during my natural life.

This indenture made the eighteenth day of December in the year of our Lord One thousand seven hundred and forty nine between Francis CONSAULVO of Princess Anne County of the one part and William CONSAULVO Jun. Of the same county of the other part. Henceforth the said Francis CONSAULVO for his consideration of the sum of six shillings ____ money of Elisabeth to heirs in hand paid by the said William CONSAULVO Jun. the receipt whereof he doth hereby acknowledge, hath bargained and sold by these present do bargain and sell into the aforesaid William CONSAULVO Jun. One hundred acres of land be that more or less. His part of a tract of land formally belonging to Keeling according to the known _____ Sound as the same is now hath been held by the said Francis CONSAULVO lying and being on the Eastern Shore of Lynhaven Parish the county aforesaid joining on John Bishops land and Langleys land and Richard Garners land remainder and remainders thereof. All the singular the assets of _____ _____herein mentioned of every parts and parcal of that same. To have and to hold the said land with all the premesies hereby granted sold with this of every of the the appurtenances unto the said William Consaulvo Jun. His heirs of assigns from the day of the date hereof for _____ the full end of term of six months for those not fully to be completed and ended, to the island that by witness of these present and of the statute for transferring these into the said William CONSAULVO Jun. May be in the provisions of the land to a receipt of a grant of release of the same to him and his heirs forever. In witness thereof that here onto set his hand and seal the day and year above written.

I also wonder if there might be any connection to the following report.)

The persons appointed on the motion of Henry CONSAULVO to lay off and assign to Amy CONSAULVO her dower of the plantation whereon William CONSAULVO Senior decd lived. We having this day received their report or division in these words, to wit: Pursuant to an order of Princess Anne Court dated December 20th 1757, we the subscribers here met on the plantation of William CONSAULVO decd and there made division of the land of the said CONSAULVO between Henry CONSAULVO heir at law to the said land, and Amy CONSAULVO widow of the said William CONSAULVO, in manner following, to wit: the dividing line of the said land begins at a small sapling pine markt on one side that stands on the south side of plantation at the edge of the wood, and thence runs about N E B N about one hundred and twenty strides or near it, to a large old oak stump in the old field, standing near a ditch, thence runing about W S W to a large mulberry tree which stands in the yard, and between the two dwelling houses, thence about W over a small run to a small mulberry tree that stands in a cornfield and markt, and thence to a markt pine standing a little in the woods; of which partition so made we assign that part of that plantation which lies on the south side and westerly, together with the orchard and dwelling house standing thereon to Amy CONSAULVO for her dower of the said land; also the dairy and furthest barn and little hen house which stand on the other part of the land, and one of the corn cribs, unless the said Henry CONSAULVO, will and does, in due time build or cause to cause to be built at his own expense a crib of equal dimension with one of the others, on that part of the land which is herein set apart for her the said Amy CONSAULVO's dower, and for her the said Amy's own proper use and advantage; and moreover the said Amy CONSAULVO is to have priviledge of geting rail timber and firewood also free access to and benefit of the spring andc for the use of the plantation out of any part of the woods belonging to the said land, as witness our hands this 17 day of January 1758. Francis Thorougood Land, Andrew Stewart, Chr Wright, Its therefore ordered that the parties be satisfied with and hold their part of the said land andc separate and divided according to the division aforesaid from the part of each other.

Andrew CONSAULVO, Charles CONSAULVO, Anthony LEGGETT and Frances his wife, John WALLIS and Mary his wife and Priscilla CONSAULVO an infant by Maxl. Boush her guardian vs Henry CONSAULVO eldest son and heir at law of William CONSAULVO deceased. And AMY CONSAULVO widow of the said William CONSAULVO in Chancery, William Keeling and the said Lemuel Cornick, Thomas Key Walker and William Woodhouse Jr., being granted by the advice of this court to make partition of the Negroes contained in the Campbells bill between the said Campbells of ___ Lemuel Cornick, William Woodhouse and Thomas Key Walker these of the said grant this day returned their report of the division of the Negroes aforesaid in these words to make agreeable to an order of Princess Anne Court of the subscribers met and divided the Negroes belonging to the estate of William CONSOLVO deceased, between the following persons in the following manner. To Henry CONSAULVO, Toney valued at thirty two pounds, ten shillings, he paying to Priscilla CONSAULVO, thirty three shillings and four pence, to Andrew CONSAULVO, Phillis valued at thirty five pounds, he paying to John Wallis four pounds and 3 shillings and four pence. To Charles, Orven valued at 35 pounds, he paying to John Wallis 3 pounds, 13 shillings and 4 pence and to Priscilla CONSAULVO 10 shillings. To John WALLIS Cuffy, fifteen pounds. Rose, eight pounds to the service of Andrew CONSAULVO four pounds three shillings and four pence. Charles CONSAULVO 3 pounds and thirteen shillings and four pence. To Priscilla CONSAULVO, Mos fifteen pounds, Tom 12 pounds and to ____ of Henry CONSAULVO thirty three shilling and four pence. Of Charles CONSAULVO ten shillings. Each part being 30 lbs. 16 shillings and eight pence. Also assigned to the widow Davis, Sarah, Grace and Dick. This is our report given under our hands this 17 day of April 1758. Lemuel Cornick, William Woodhouse, Thomas Key Walker, of the parties Cambells of ___ being content therewith, it is considered of the division of by this court that the Campbells of ____ hold that this agreement of the parts of the said Negroes aforesaid according to the report or partition made in the manner aforesaid separated and divided according to the partition aforesaid from the _____ each other and it is further ordered that the parties aforesaid pay the cost of the said suit equally amongst them.
(note from Lanette: Charles Consolvo/Consolver was born in Princess Anne Co., Virginia. I found him there listed with his parents. Later, members of his family migrated to Albemarle Co., including his son James Consolver/Kinsolving. The Consolvers were all slave owners, including James Kinsolving who owned between 80-90 slaves. I have list of all of them on some of the court documents. Here is the division of slaves and money going to Charles and family. When Henry dies, he still owns two of those slaves given to him by this division of property. It was confirmation that he was the correct Henry that I was following to his death.)

THIS INDENTURE made the sixteenth day of March in the year of our Lord one thousand seven hundred and sixty two BETWEEN Henry CONSAULVO of Princess Anne County of the one part and Thomas Keeling of the same county of the other part WITNESSETH that the said Henry CONSAULVO, for and in consideration of the sum of forty seven pounds current money of Virginia to him in hand paid by the said Thomas Keeling at and before the insealing and delivery of these presence, the receipt he doth hereby acknowledge and thereof and of every part and parsel thereof clearly requit and discharge him the said Thomas Keeling his heirs, executors and administrators and every of them and by these presence doth hereby acknowledge have granted bargained sold aliened and released and confirmed unto the said Thomas Keeling and to his heirs and assigns forever one certain piece or parsel of swamp land on the head of Lynhaven River, being part of a pattent grant to Masimilian Boush for two hundred and eleven acres, bounded as followeth, beginning at a markt beech and runing thereby a line of markt trees to a three forked beech, a corner tree of of Lewis Conners farm, thence SE by a line of markt trees running to the first mentioned beech bordering one hundred acres, which the abovesaid Boush sold to William CONSAULVO decd with the reversion and reversions, remainder and remainders unto, issues and profits thereof, and also all the estate right or title to that property claim and demand whatsoever of him the said Henry CONSAULVO in or unto the said land or Premises or any part thereof with the appurtenance TO HAVE AND TO HOLD the said land and premises hereby granted, bargained and sold with their and every of their appurtenances unto the said Thomas Keeling his heirs and assigns for ever and the said Henry CONSAULVO for himself his heirs executors administrators doth hereby covenant and grant to and with the aforesaid Thomas Keeling his heirs and assigns that the said Henry CONSAULVOhis heirs all and every of the aforesaid and intended to be hereby granted land with the appurtenances unto the Thomas Keeling his heirs and assigns against him the said Henry CONSAULVO his heirs and assigns and all and every other person or persons whatsoever lawfully claiming any estate right or title to the before mentioned and granted land and premises or any part thereof SHALL AND WILL WARRENT seised of and in the before specified land and premises with the appurtenances of a good sure perfect and absolute estate of inheritance in fee simple and hath good right to convey the same unto the said Thomas Keeling his heirs and assigns aforesaid and that it shall and may be lawfully to and for him the said Thomas Keeling his heirs and assigns forever hereafter peaceable and quietly to occupy and injoy the said land and all other the premises hereby granted with the appurtenances without any manner of let suit trouble inturruption of him the said Henry CONSAULVOhis heirs or assigns or any other person or persons whatsoever IN WITNESS whereof these presence I have hereunto set my hand seal the day and year first above written Henry his X mark CONSAULVO and seal Signed sealed and delivered in the presence of Robert Huggins John Thorowgood Senior William Flear Princess Anne Co: At a court held the 16th March 1762 The within deed of bargain and sale was acknowledged in open court by Henry CONSAULVO and the same being first privily examined relinquishing her rights of dower in the property, therefore is ordered to be recorded.

John (Jonathan) CONSOLVER lost right arm and left hand at Waxhaws, South Carolina in the Revolutionary War. Pensioned by the state of Virginia in 1781, by the Federal Government in 1789. He was in Bedford Co., Virginia in 1782. Later to Washington Co., Virginia. Battle of Waxhaws: Tarleton’s Legion overtook and defeated Colonel Abraham Buford and his Third Virginia Continentals as they returned through the Waxhaws area toward North Carolina after the fall of Charleston (also known as Buford’s massacre). The Waxhaw settlement, just off the Great Wagon Road, today covers parts of both Carolinas in an area southeast of Charlotte.

Daniel Morgan led his army of tough Continentals and backwoods militia to a brilliant victory over Banastre Tarleton’s battle-hardened force of British regulars. The report of the Secretary of War printed in 1835 shows John CONSOLOER on a list of invalid pensioners at the Virginia Agency whose place of residence could not be ascertained because of the destruction of papers when the public buildings were burned in 1814. He served as a private and was granted a pension of $60 per annum from Sept. 1789 for disability incurred during his service in the Revolutionary War. A record in the Pension Office shows his name as John CONSOLVER and that he died prior to 4 March 1810.

Jacob CONSOLVER, husband of Rachel Archer, was living in Shelby Co., Ohio when he testified about the disputed estate of his deceased father-in-law David Archer. He said that he had been acquainted with David Archer for 21 or 22 years since 1811. David Archer must have died about 1832-1833. Jacob CONSOLVER said that one or two years before David Archer died, he had sold his 60 acres near David Archer's in Lost Creek Twp., Miami Co. for about $200. Jacob Archer's family was on the 1830 Federal Census in Brown Twp., Miami Co., Ohio.

After the death of William HALL of Dinsmore Twp., Shelby Co., Ohio, his property was sold to pay debts by Samuel Elliott, administrator of the estate. Named as defendants in the Court of Common Pleas were William Hall's widow, Sarah, and Alexander Hall, Isaac CONSOLVER & Jane Consolver, William Hall, Samuel Hall, Sarah Margaret Hall and Elizabeth Hall. The last four children named were under fourteen years of in 1846. The estate was first appraised at approximately $150 and there were debts of $140. The property finally sold at auction on 14 Aug 1848 to Fielding Drake for $105.50. The land consisted of 40 acres more or less Southeast quarter of the South East quarter of Section One, Township Seven South of Range Six East (S1 T7S R6E)
