(Samuel T. Alston was born 1806 in Warren Co., died July 16, 1860 Warren Co.,NC, the son of Samuel Alston & Elizabeth Faulcon; he was married to Ruina Temporance Williams, b. 1814/d. Feb. 25, 1897)

 

Know all men that by these presents that I, SAM'L T. ALSTON SR. of the County of Warren and State of North Carolina this the 22nd day of June A.D. 1860, being of perfect mind and memory for which I feel thankful to Almight God but knowing th uncertainty of life do think proper to make this my last Will and Testament.
In the first place, I wish my executor to pay all of my just debts out of my estate of such property as he may think best for the interest of the estate.
Secondly- I give to my beloved wife RUINA T. ALSTON all the property I possess of every description real and personal to her and her heirs forever and I hereunto appoint my son ROBERT W. ALSTON Executor to this my will - and I have this the day and date above written put my hand and seal.

A paper writing purporting to be the last will and testament of SAMUEL T. ALSTON, decease, is exhibited for probate in Open Court by ROBERT W. ALSTON the executor therein named and the due execution thereof by the said SAMUEL T. ALSTON is proved by the oath and examination of ROBERT E. WILLIAMS and SOLOMON WILLIAMS, the subscribing witnesses thereto. It is therefore considered that the said paper writing is the last will and testament of the said SAMUEL T. ALSTON and the same is ordered to be recorded and filed. And thereupon the said ROBERT W. ALSTON Executor as aforesaid duly qualifies as such, by taking the oath required by Law.

If to be found in your County, to be and appear before the Judge of our Superior Court of Law, at the next Court, to be held for Warren County, at the Court House in Warrenton, on the third Monday after the fourth Monday in March next, then and there to answer ROBERT W. ALSTON, Executor of SAMUEL T. ALSTON to use of SAMUEL W. EATON, Guardian of LAFAYETTE B. EATON of a plea that they render unto him the sum of Sixty four & 25/100 dollars, which &c, damages Seventy five Dollars.
Herein fail not and have you then and there this Writ.
