State of Georgia, Warren County.

In the name of God Amen!

I, Matthew English of the State and county aforesaid being in body feeble but of sound mind and memory do make, ordain and appoint this my last Will and Testament in manner and form following to wit, I resign my soul to God and my body to the Earth.

Item 1St. It is my will and desire that all my just debits be paid first.

Item 2. I will and bequeath unto my son Aron English in trust for my daughter Olive Scruggs wife of William G. Scruggs and the heirs of her body one negro girl by the name of Epsey which said negro girl is not to be subject or liable in any wise to the payment of the debits or contracts of the said William G. Scruggs.

Item 3rd. It is my will and desire that all my negroes to wit, Emily, Sharlotte, Dick a boy and Dick and his family Amber, Lucinda, & Jacob shall be valued by three disinterested persons and that at valuation they shall go to the following named persons, they paying to my estate unto the hands of my Executors the sum or sums at which the said negroes are valued to be equally divided share and share alike amongst all my children except my daughter Olive Scruggs.

Item 4th. It is my will and desire that my daughter Ginsey Hobbs shall have a negro girl by the name of Emily at valuation by paying to my executors the sum at which said girl is valued to be equally divided as aforesaid in the third item of this will.

Item 5th. It is my will and desire that Sarah Aldred my daughter shall have a negro girl named Charlotte at valuation by paying to my Executors the sum at which said girl is valued to be divided as aforesaid in the third item of this will.

Item 6th. It is my will and desire that my son Joel English shall have a boy by the name of Dick, at valuation by paying to my executors the sum at which he is valued to be divided as aforesaid in the third item of this will.

Item 7th. It is my will and desire that my son John English shall have the following Negroes at valuation, to wit, Dick a man, Amber his wife, Lucinda a girl & Jacob, a boy, he John paying to my executors the sums at said negroes are valued to be equally divided as aforesaid.

Item 8th. It is my will and desire that my son Thomas English shall have the land on which I now live at valuation he paying to my Executors the amount of valuation to be equally divided as aforesaid of my negroes, amongst all my children share and share alike except my daughter Olive Scruggs wife Wm. G. Scruggs.

Item 9th. It is my will and desire that my grand children, Abner Norris, William Norris & Chapman Norris children of my daughter Nancy Norris to one share between them, of my estate, and that my son William English shall receive the amount and put it out at interest from year to year for said children to be paid to them as they come of age.

Item 10th. It is my will and desire that all my stock of every description with every other species of property (not before mentioned in this will) that I may die possessed of shall be sold and that my daughters Elizabeth Kitchens, Olive Scruggs, Sarah Aldred, Jinsey Hobbs, and my grand children Abner Norris, William Norris & Chapman Norris, shall first receive the following sums over and above an equal division to wit, fifty dollars each to Elizabeth Kitchens, fifty dollars to Olive Scruggs, fifty dollar to Sarah Aldred, fifty dollars to Jinsey Hobbs, & fifty dollars to my aforesaid grand children. The balance of the money, if any arising from the sale of the stock _ 6 - to be equally divided amongst all my children, (my grand sons of Nancy Norris to receive one share between them) except my daughter Olive Scruggs, who is no share of said balance.

Item 11th. I do hereby nominate and appoint my sons Aron English & William English, Executors to this my last Will and Testament.

Georgia, Warren County. Before us Micajah Rogers, & J. I. C. Franklin, Justices of the Inferior Court in & for the county aforesaid, personally came Benjamin Matthews, Henry Pool, & John Moore, and after being duly sworn, depose and say that they saw Matthew English sign & seal (by making his mark) the above & foregoing instrument of writing as his last will & testament, and that he was at the time of his so doing of sound & disposing mind and memory and that they signed the same in his presence & at his request & in the presence of each other Sworn to & subscribed before us, this 18th day of January 1838.
