Union Inferior Habes Capes Court - May Call Term, 1866

Raney L. Chastain

 vs

The State & W. W. Erwin

 It having been satisfacterley shown to the Court that Reney L. Chastain, who is

charged with the offence of the murder of Elisha Stanley and Ivan Hughes, was at

the time of the alledged offence bond fide a soldier of the Army of the

Confedreate States acting in good faith under orders from his superiors

officers.  It is therfor ordered by the court that said Reney L. Chastain be and

herwith discharged from the custody of W. W. Erwin, Depty Sheriff, and from

further and all liability upon his said bond for his pursonal appearance at next

Superior Court to be held in and for the County of Fannan on the first Thursday

after the second Monday in May this presant month.

This 11th day of May, 1866

Union Habas Corpeus Court 1866

State of Georgia

Union County

 It appearing to the court that Joseph Reid was under orders from his Superiors

Officers of the Confedrate Army to arrest all persons lying out and all persons

who were passing to and from the enemy, not to send them to head quarters but to

put them to deth and it furth(er) appearing to the court that Capting Reid

refused to obey such orders and was therefore removed from this place and others

specially detailed to do this dirty work, it is ordered that the said Thomas R.

Self, Sheriff of Towns County, herwith discharge the said Joseph Reid from his

custody.  By virtur of the warrent the cause of his arrest and debulean(?) and

that a duely certifide copy of this prceeding be sent to the next Superior Court

of said county of Towns by the clerk of this court, this 28th day of April 1866.

Union Habas Capers Court 1866

State of Georgia

Union County

 It appearing to the court that the wearrent under which James H. Ross was

arrested for assault and battery is not supported by any Bill of Inditement of

Speciel Parscuted (special prosecutor?) and it further appearing to the court

that the property alledged to have been impressed or taken, viz a doble barrel

shot gun and was taken by said Ross while in the service of the Confedrate

States and under orders from an officer of said Army before the final surrender

of said Confedrate Army in good faith, ordered therefore by the court that the

said Thos. R. Self, Sheriff of Towns County, do herewith discharge the said

Henry Ross from his custody under and by virtue of said warrent, and that a copy

of this proceeding duly certifide be forward to the Superior Court of Towns

County by the clerk of this court, this 28th April 1866.

Union Superior Court April 1866

State of Georgia

Union County

 It appearing to the court that the said Solomon Dyson, Daniel M. Killan, Samuel

and Marit Queen were bonafide soldiers of the Armey of the Confedrate States and

under orders from there officers to sease the property alledged to have been

taken in the Bill of Inditement, it is ordered  that the said Thomas R. Self,

Sheriff of Towns County, Ga. do herwith discharge the said Solomon Dyson, Daniel

M. Killan, Samuel and Merit Queen from custadey under and by virtue of said

warrent and Bill of Inditement and that a certifide copy of these proceedings be

sent to the Superior Court of Towns County by the clerk of this court, this the

25th April 1866.

(A later recording of this list of destitute citizens indicates that the State

of Georgia sent an amount of money to aid Union County’s surviving families of

soldiers and those disabled from their wounds.  The contribution to Union County

enabled the county courts to give to each person who was considered destitute,

and others added later, the whopping sum of 50 cents each.)

NOTE:  Additions in parentheses are my own.  I have made every effort to

transcribe these records as exactly as humanly possible, though I am sure I have

made some transcription errors, due to the Clerk of Court’s atrocious

handwriting.  For those, I apologize.
