WILL OF JAS. T. ELLIS

 

GEORGIA,  SPALDING }

                     COUNTY    }              I, J. T. Ellis of said State & County being of sound and disposing mind & memory do evoke this my last will and testament.

Item First.  I give, bequeath & devise to my wife Nancy J. Ellis during her natural life or widowhood a life interest in all property both real & personal choses in action notes & accounts except my interest in the William Ellis estate.  My wife to have the use & benefit of said property so will(ed) to her during her natural life & widowhood free from debts she may make contract.  This request is made in lieu of dower.

Item Second.  Upon the death of my said wife Nancy J. Ellis, I give bequeath & devise to my daughter Emma Dupree my home place & all of lots of said No. 65 & 66 that I own that lies south of the S. G. & N.A. R.R. during her natural life free from any debts or contracts that she may make.  At her death the said land is to be held in trust by my Executor for her children if they survive her during their lives, at their death said lands to be divided between the children of Emma Dupree’s children, that is Emma Dupree’s grandchildren.  If Emma Dupree’s children or Grandchildren should not survive her then said property shall revert to my estate, and be divided as herein after provided.

Item Third.  Upon the death of my said wife Nancy J. Ellis, I give bequeath & devise to my son Sam T. Ellis a life interest in the following property free from any debts or contracts that he may make all that part of Lots No. 63 & 64 which I own lying south of the S. G. & N. A. R. R.  At the death of the said Sam T. Ellis said lands to go to his children in fee simple.

Item Fourth.  I give bequeath & devise to my son W. A. Ellis my undivided interest in the undivided estate of William Ellis said interest not to be subject to his debts.

Item Fifth.  Upon the death of my said wife Nancy J. Ellis all of the remaining property not specially willed above to be sold & the same equally divided among the following:  Martha Nunnally, Blanche Westbrook & T. Ellis Drewry together having one interest, H. E. Ellis, R. A. Ellis, & J. R. Ellis, W. A. Ellis.

Item Sixth.  I hereby constitute & appoint my son J. R. Ellis, Executor of this my last will & testament.  He is to act & qualify without giving bond.  He is authorized & empowered to sell all property except that Specially willed that I die possessed of at private or public sale to pay my debts if there should be any and my funeral expenses.  The said J. R. Ellis is also hereby appointed the trustee of my said wife to act for and manage my estate for her.  He has power to sell at any time any of the property of my estate except that specially willed for the benefit of my wife either at public or private sale.  I also appoint the said J. R. Ellis trustee of Emma Dupree to see that the provisions of this will is carried into effect as to her bequest.  I give to the said Executor J. R. Ellis two hundred dollars in lieu of commissions to carry this will into effect.  This the 1st day of September 1886.

Ellis of said State & County being of sound and disposing mind memory & discretion make declare & proclaim & declare this as a codicil to my foregoing will.  I revoke the fourth item of said will & so much of the fifth item as will and bequeaths anything to W. A. Ellis hereby revoking all bequests to the said W. A. Ellis.  The said W. A. Ellis is not to receive any interest or benefit from my property or under this will.  I further will & bequeath my undivided interest in the undivided estate of William Ellis to Martha Nunnally, Blanche Westbrook & T. E. Drewry together having one interest, H. E. Ellis, R. A. Ellis & J. R. Ellis.
