Will of Charles Carter

July Term 1842

In the name of God Amen... I, Charles Carter, of the state of Georgia and County of Oglethorpe, being poorly and weak in body, but sound of mind and knowing that it is appointed for men once to die, do publish this to be my last will and testament, revoking and disannulling all other wills be me made. First, it is my will and desire that my body be decently intered by my friends and executors, and I will and bequeath my soul to Almighty God who gave it me, in hopes of its gracious acceptance with Him.

1st Item - It is my will and desire that all my just debts be paid first out of my estate, and the remainder to disposed of in the following manner:

2nd Item - I give unto my beloved son, Robert G. Carter all my land that I hold in the said County of Oglethorpe, except one square acre where the burying ground now is.

3rd Item - I give unto my son Robert G. Carter the one half of my cows and calves, the one half of all my hogs of every description, the one half of my stock of sheep and also my cotton gin and running gear, and also the one half of all the plantation tools of every description, and the one half of all my kitchen furniture of every description.

4th Item - And after my death the Negroes and balance of stock, my land in Early and also my tract of land in Lee County, now Sumpter County, and all the rest of my property that I have not disposed of in the following manner:

5th Item - To be equally divided with Frances Kidd, Edward Carter, Robert G. Carter, Mary Dupree, Nancy Kidd, Elizabeth Farmer's children and Holley Gray.

6th Item - I do hereby nominate, constitute, and appoint my sons, Edward Carter, Robert G. Carter executors of this my last will and testament, and I hereby revoke and disannul all former wills by me made. In testimony whereof I have hereunto set my hand and affixed my seal this twentieth day of April in the year of our Lord 1842.
