This indenture made
this the twenty-sixth day of September 1878 between Simon W. Wilburn of the
state & county fore said of the one part and Obediah Cook of the same
place of the other part. Witnesses that said Simon W. Wilburn for and in
consideration of the sum of one hundred and sixty dollars to him in hands said
at & before the sealing & delivery of his presents. The receipt
whereof is hereby acknowledged both granted bargained said and conveyed unto
the said Obediah Cook his heirs & assigns all that track or parcel of land
situated lying & being in the county of one said known was the place where
on M. H. Wilburn now resides said tract of land willed me by my grandfather,
James Wilburn containing fifty acres more or less beginning on this creek and
Lacy line thence to a black Jack on Rooks Line near A. T. Wilburn's shop
thence a north course to the Beaver Ruin Creek thence down said creek to the
mouth of Walls Spring Branch said courses in accordance with item 7 of the
will of my grandfather James Wilburn to have and to hold said tract or parcel
of land to him the said Obediah Cook his heirs and assigns together with all
and singular the rights members and appurtenances thereof to the same in any
manner belonging to his and thereon proper use benefit and behoof and the said
Simon W. Wilburn for himself his heirs executors and administrators the said
bargained promises to the said Obediah his heirs & assigned will warrant
and forever defend the rights and letters thereof against themselves and
against the claims of all other persons whatsoever. In witness where of said
Simon W. Wilburn has hereto set his hand offered his seal the day & year
above written
