Last Will & Testament of Branch Ligon

In the name of God Amen! I Branch LIGON being of advanced age, but of sound disposng mind and memory, and being desirous to settle my worldly affairs, while I have strength to do so, do make this my last will and testament, hereby revoking all wills by me at anytime heretofore made.

I will and bequeth to my daughter Martha MILLER widow of Bengamin Miller dec'd, six hundred dollars in money and such surplus money as I may have on hand at the time of my death, over and above the six hundred dollars first above named, Also my house and lot of ten acres of land being part of lot of land no. 154 in the 21st dist. of Harris County-having such shape and form as is described in a deed made by Theophilus Miller to me- also all such stock of horses, mules, cattle, hogs etc. as I may have on hand at the time of my death together with all my household and kitchen furniture, buggy, small wagon and all my farming tools.

I give and bequeth to my daughter Pamila H. Miller wife of Joseph Miller Eleven hundred dollars if my bequest hold out.

I give and bequeth to my daughter Sarah W. BOWDEN, wife of Mr. Bowden Christian name not recollected seven hundred dollars if my bequest holds out.

I give and bequeth to the children of my deceased son F.M. Ligon to wit: Thomas Ligon, Ella Ligon, Semurinus(?) Ligon, and Woodson Ligon, Seven Hundred dollars, to be equally divided between them if my bequest holds out.

I give to my son John Ligon four hundred dollars if my bequest holds out.

I give and bequeth to my son Patrick W. Ligon One hundred dollars if my bequest holds out.

It is my desire and I so will it that my daughter Martha Miller wife of Bengamin Miller dec'd named in item 1st be paid by my executor the full amount of the money bequethed to her in Item 1, to wit six hundred dollars, before any amount is paid to my other Legatees, as it is my desire that she have that amount sure, and if my estate should fall below my bequest my other legatees to sustain the loss pro rata.

My son William Ligon dec'd, James Ligon, Thomas Ligon having received their portion in full of my estate, I give them nothing.

I hereby constitute and appoint Joseph Miller my son in law my executor to this my last will and testament witness my hand and seal . This 11th day of May 1870.

Signed, Sealed, Published and declared by the above named Branch Ligon as his last will and testament in presence of us, who at his request in presence of each other, have subscribed our names as witnesses hereto. May 11th, 1870
