GEORGIA, HANCOCK COUNTY

This Indenture made and entered into , this twentieth day of December, one thousand eight hundred and twenty four, between William Arnold of the County of Putnam , and Jacob P. Turner of the County of Hancock and state aforesaid, executors of the last Will and Testament of John Berry, late of this County of Hancock and state aforesaid dec’d. of the one part--And Jonathan Roach of County of Hancock and state aforesaid of the other part. Witnesseth. That the said William Arnold and Jacob P. Turner executors as aforesaid by virtue of an order from the Inferior Court of the said County of Hancock - and state aforesaid when sitting for Ordinary Purpose bearing date of November the first 1824, thereby authorizing them, executors as aforesaid, to sell the real estate of the late John Berry dec’d. as aforesaid, and ( after being duly and publicly advertised agreeably to law) did expose to public sale and outcry, at the Court house in the Town of Sparta and County of Hancock, within the lawful hours of sale, on the first Tuesday in December instant, a certain tract of land (herein after described) being the real estate of the late John Berry dec’d. as aforesaid, and when so exposed to public sale and out cry, the said Jonathan Roach, being the highest and best bidder, it was knocked off to him at the price and sum of thirteen hundred and ten dollars ($1.310.)

Now the said William Arnold and Jacob P. Turner executors as aforesaid, for and in consideration of the aforesaid sum of thirteen hundred and ten dollars to them in hand paid at and before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, hath granted, bargained sold & conveyed, and by these presents doth grant, bargain, sell and convey unto the said Jonathan Roach, (all that tract or parcel of land, whereon the late John Berry dec’d. as aforesaid last lived, situate, lying, and being in the County of Hancock and state aforesaid, on the waters of Buffaloe adjoining Thompson, Binion, Turner and said Roach, containing by estimation three hundred fourteen and one half acres (314 1/2) be the same more or less, with the exception of that part excepted on the day of sale aforementioned that lies in a triangular form, bounded West by James Thompson’s lane and East by the main public road, containing three acres, be the same more or less).

With all and singular the rights, members & appurtenances thereunto belonging or in any wise appertaining.

To Have and to Hold, the aforementioned tract or parcel of land, with all its appurtenances, to the only proper use, benefit and behoof of the said Jonathan Roach, and the title to the said tract of land, the said William Arnold and Joseph P. Turner executors as aforesaid to the said Jonathan Roach, his heirs and assigns in fee simple, will Warrant and forever defend against the claim or claims of every and all persons whatsoever firmly by these presents.

aforesaid, hath hereunto set their hand and seals, the day and year above written.
