            This Indenture made the 24th day of January in the year of our Lord one Thousand Eight hundred and sixty one between William McDowell Berry of the County of Hancock of the one part and James E. Berry Sen of the County of Hancock of the other part.  Witnesseth that the said William McDowell Berry for and in consideration of the sum of Four hundred dollars in hand paid at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged has granted bargained sold aliened conveyed and confirmed and by these presents does grant bargain sell alien convey and confirm unto the said James E. Berry Sen his heirs and assigns all his certain interest in a certain tract of land lying in said county which is conveyed by will of his mother Georgia Ann Berry on record in office of Ordinary in Book U page 103 - the same being an interest in remainder to him as one of the children of said Georgiann Berry which begins when the ending of the life Estate conveyed by said will to the party of the second part - the interest herein conveyed being given by the first item of said will wherein the land is more fully described.  To have and to hold the said above described property with all and singular the rights members and appurtenances thereto appertaining to the only proper use benefit and behoof of him the said James E. Berry Sen his heirs Executors administrators and assigns in fee simple; and the said William McDowell Berry the said bargained property as above described unto the said James E. Berry Sen his heirs executors administrators and assigns against the said William McDowell Berry his heirs Executors and administrators and against all and any other person or persons shall and will warrant and forever defend by virtue of these presents.   

 

            In witness whereof the said William McDowell Berry has hereunto set his hand affixed his seal and delivered these presents the day and year first above written.

Personally appeared before me Jas T. Stanton who being sworn says that he signed the foregoing deed as a witness to its execution & that he saw John W. Stanton do the same and that he saw Wm Mc Berry sign and seal & deliver the same for the purpose therein expressed.
