HANCOCK COUNTY.

I Albert M. Berry of said county, being now of sound and disposing mind & memory, and conscious of the uncertainty of the continuation of life do make and declare the following the disposition of my worldly Estate.

I direct that any & all just debts be paid as soon as may be conveniently be done from cash in hand, money due or from the avails of the crop.

I give & bequeath to my beloved wife the carriage & pair of horses used with it also the household & kitchen furniture on hand at my decease - and also my watch.

I direct that the plantation be cultivated and the negroes be employed there for the benefit and maintenance of the family and the Education of my daughter - until she shall by marriage require her portion to be set off to her, or if my dear wife shall marry, in either Event I direct that

all my estate real and personal in hand, at the time, including the increase thereof from every source be Equally divided between my beloved wife and my dear daughter and the portion that shall be allotted to my daughter shall be held by my wife if then in life in trust for my daughter that she may have the enjoyment thereof exempt from the claims of any husband and to this End I direct that on her marriage said portion shall be vested in trustees for her separate use, of whom my dear wife if in life shall be one, as she may please, and in the event of the decease of my daughter before attaining full age or marriage I give her portion of said Estate to my dear wife if alive, and if she should be dead thus to the heirs at law of my daughter.

I authorize the Executor hereof to sell any of my slaves, when circumstances in his discretion shall render a sale expedient and advantageous to my family and to invest the proceeds of such sale or sales in other property - or in such other manner as he may conceive most beneficial to my family.

I constitute and appoint my friend William Fraley Executor of this my last will.
