A paper purporting to be the last will and testament of Mrs. Angelina H. Berry dec’d being produced in open Court by William Fraley one of the nominated Executors thereof & the due legal executor of said instrument by the said A. H. Berry dec’d as her last will and testament being proven by the evidence of Benjamin T. Harris and Mary Jane Harris two of the subscribing witnesses thereto & that she was at the time of sound and disposing mind and memory. No objection being made to the proceeding. It is therefore considered and adjudged by the Court that said paper is clearly proven to be the last will and testament of the said Angelina H. Berry deceased & that as such it be admitted to record and that the nominated Executor William Fraley be now qualified as such.

Upon the application of William Fraley Executor of Angelina H. Berry deceased - It is ordered that Benjamin T. Harris, Tuttle H. Audas, Lorenzo S. Stewart, Charles R. Knowles and Richard M. Johnston be and they are hereby appointed appraisers of the Estate of said deceased and that they or any three of them being first duly sworn do make said appraisement.

GEORGIA, HANCOCK COUNTY

I Angelina H. Berry of said County and State being of sound and disposing mind & memory but conscious of the great uncertainty of human life for the purpose of making such a disposition of my Estate as to me seems reasonable and just, do make publish & declare this to be my last will and testament.

ITEM 1st.

The Executors hereof are requested to erect a tombstone over the graves of each of my family & for this object they are authorized to reserve the necessary amount of money from my Estate.

ITEM 2.

I give to my daughter Charlotte for and during her life all my estate whether joint under the will of my deceased husband or therewise - the same to be free and exempt from the liabilities of any husband she may have and to this end I appoint William Fraley Trustee for my said daughter. If my daughter marries, at her death the property herein bequeathed, to go to her child or children if any - if not to her husband if in life - but should she die before marriage or after marriage leaving no husband or children then the property to go to Austin W. Berry if in life, if not to Winfield Cook.

ITEM 3rd. After the payment of the debts of the Estate I give to my brother in law, Austin W. Berry the sum of three thousand dollars & I direct the Executors hereof to pay this sum over to him from the annual crops that the Estate may not be embarrassed - if he dies before the whole or any portion of this sum aforesaid is paid over, the balance or whatever portion is not paid to return

to my general estate. I give to him my gold pen & pencil and the furniture in his bedroom.

ITEM 4th.

I give to my friend Mrs. Elisa Powell a pair of iron And Irons, one pair of shovel and tongs, one washstand and my split bottomed chairs.

ITEM 5th.

I give to my friend Martha J. Fraley my wire safe.

ITEM 6th.

I appoint my friends William Fraley and Martha J. Fraley guardians of the person of my daughter Charlotte during her minority.

ITEM 7th.

I desire the Executors hereof to reserve for my daughter Charlotte my Bureau, my trundle bed & its furniture - the rest of my household furniture to be sold by my Executors at public or private sale in their discretion, the kitchen furniture to be reserved for the plantation use.

ITEM 8th.

I Nominate Constitute and appoint my friends William Fraley & Thomas T. Windsor Executors of my last will and testament.

In testimony whereof I have hereunto subscribed my name and affixed my Scroll for a seal this 25th day of February 1850.
