STATE OF GEORGIA � Butts County Georgia
This indenture made this the Twenty Sixth day of February in the year of our
Lord Eighteen Hundred and Fifty-Eight between Eliza Bankston, Cynthia Bankston,
Martha Bankston and Isaac Bankston of the County and State of aforesaid of the
one part and Clayton M.Goody of the same place of the other part. Witnesseth,
that the said Eliza Bankston, Cynthia Bankston, Martha Bankston, Isaac Bankston
did on the Twenty Third day of February, Eighteen Hundred and Fifty Seven make
and delivered to C. F. & J. W. Newton therefore several promissory notes, three
of which said notes are for the sum of forty dollars principal and the other of
which said notes is for the sum of thirty four, twenty seven cents principal
and the aggregate sum of all of which said notes is the sum of one hundred and
fifty four dollars and twenty seven cents principal, which the said Eliza
Bankston, Cynthia Bankston, Martha Bankston and Isaac Bankston promises to pay
the said C. F. & J. W. Newton or bearer the said several sums of money
mentioned in said promissory notes eight days after the several inspection
dates thereof for value received and all of which said several promissory notes
for the said Clayton M. Coody has become the bearer; and witnesseth that the
said Eliza Bankston, Cynthia Bankston, Martha Bankston and Isaac Bankston did
on the twenty third day of December Eighteen Hundred and Fifty Seven make and
deliver to Charles F. and James W. Newton their certain other promissory note,
whereby on and after the date thereof why the said Eliza Bankston, Cynthia
Bankston, Martha Bankston and Isaac Bankston promises to pay the said Charles
F. and James W. Newton the sum the sum of thirty six dollars and fifty two
cents for value received and the Sara Clayton M, Coody has become the bearer of
said promissory note and witnesseth that the said Isaac Bankston, did make
delivery to the said Clayton Coody his two certain due bills, one of which is
dated on the seventh day of March, eighteen hundred and fifty six for the sum
of seventeen dollars for value received and the other of which said due bills
is due on the twenty sixth day of February eight hundred and fifty eight for
the sum of twelve dollars for value received and witnesseth that S. J. Bankston
did make and deliver to the said Clayton Coody his two several due bills one of
which is dated on the first day of January eighteen hundred and fifty seven for
the sum of twenty two dollars and fifty five cents, for value received, and the
other of which said are bills is dated on the twenty first(?) day of February
eighteen hundred and fifty eight, for the sum of thirty six dollars and sixty
six(?) cents, for value received. Now for and in consideration of the sum of
five dollars, by the said Clayton M. Goody to the said Eliza Bankston, Cynthia
Bankston, Martha Bankston and Isaac Bankston, in hand paid at and before the�..

line would copy. The below is a continuation of the same document, Page G-354.
bargained and sold and doth by these presents grant-bargain and sale unto the
said Clayton M. Goody his heirs and assigns, all the track or parcel of land
containing one hundred and a quarter acres more or less, the same being the
east half of lot number fifty two in the fourth district of originally Monroe,
now the county of butts, with all the rights numbers and appetencies to said
parcel of land in any wise appertaining or belonging. To have to hold the said
bargained promises to the said Clayton M Coody, his heirs and assigns and their
own proper benefits and behoof forever. And the said Eliza Bankston, Cynthia
Bankston, Martha Bankston and Isaac Bankston for themselves their heirs
executors and administrators the said premises unto the said Clayton M. Coody
will warrant and forever defend against the claim of themselves and their heirs
and against the claiming of all their persons whatever provisions nevertheless,
that if the said Eliza Bankston, Cynthia Bankston, Martha Bankston and Isaac
Bankston, their heirs executors, administrators shall will and justly pay, in
cause to be paid unto the said Clayton M. Coody, his heirs and assigns he said
several afore mentioned sums of money in the said promissory notes and all
bills mentioned with the lawful interest of the same ascending to the time of
said promissory notes and are bills given and from henceforth, as will this
present indenture, as the right to the property thereby conveyer as the
aforesaid several promissory notes and due bills shall cease determine and be
void to all interest and purposes. In witnesseth said Eliza Bankston,
Cynthia Bankston, Martha Bankston and Isaac Bankston have hereunto set their
hand and affixes their seals this day and year above written.

Personally came before me George Brownlee who being duly sworn deposeth and
sayeth that he saw Eliza Bankston, Cynthia Bankston, Martha Bankston and Isaac
Bankston sign seal and deliver the written mortgage in and for the purposes
therein mentioned and that the deponent subscribed the same as a witness and
said Jefferson M. Varner and so like wise sworn to present of all this 13th day
of March 1858
